Migrants to be Granted Driving License Rights in Thai National Security Policy U-Turn

For Immediate Release: 30th October 2009

In a landmark rights victory in Thailand, the Department of Transport (DoT) has announced that migrants from Burma, Laos and Cambodia, as well as a number of other minority groups, can now register ownership of vehicles and will soon be able to apply for driving licenses. The decision overturns a 15-year old discriminatory National Security Council (NSC) policy denying these rights on vague national security grounds. The positive impact will be felt by well over 1 million registered migrants and other minority persons in the country.

Gothom Arya, HRDF’s President, today welcomed the policy change: ‘This decision is to be strongly welcomed. Nothing can be gained in terms of national security by denying anyone an ability to decently live their lives in our society. Policies denying basic social rights to any group of people can only increase social tension, provide opportunities for corruption, and thereby actually undermine Thailand’s national security and reputation.’

Since 1994, DoT has relied on NSC policies to deny formal registration of vehicles and access to driving licenses to large numbers of minority groups and migrant communities in Thailand. This is despite the necessity of vehicle usage for many of them.

In late 2007, HRDF began a campaign against these policies when Region 5 Police Force launched early morning raids on Shan migrant camps in Chiangmai Province in Northern Thailand. These raids, launched on a premise of arresting illegal migrants, resulted in widespread confiscation of motorbikes on grounds of ‘suspected theft’ and on the basis that migrants had no rights to either own or ride motorbikes.

To claim back confiscated motorbikes, migrants went through arduous, expensive and often informal processes of verifying their motorbikes were not stolen, before bargaining with police as to fine amounts. Migrants were left vulnerable because DoT denied them official registration of their motorbikes and an ability to apply for driving licenses.

Following complaints to the National Human Rights Commission (NHRC), the raids quickly ceased. However, confiscation of migrant motorbikes by police on the streets of Chiangmai intensified. Until fines were reduced by around 50% recently, police were routinely fining migrants caught riding motorbikes up to 2, 000 baht (US$57) per time. Often payments were made informally. Fines for Thai’s caught riding motorbikes are often only 200 baht (US$6).

Migrants still continue to face hardship in conducting routine activities like sending children to school and buying food. HRDF therefore started negotiating with the police for an end to their confiscation and fining policy, whilst also engaging DoT to allow migrants to both register ownership of motorbikes and apply for driving licenses. Once initial negotiations failed, HRDF supported Shan workers to formally register ownership of their motorbikes and also submit driving license applications. These applications were initially rejected so these decisions were then appealed. It was then that DoT agreed to grant these rights in a circular issued on 13th October 2009. This decision was made public in a DoT news release today.

Gothom concludes: ‘This decision is a landmark step forward for minority rights in Thailand. HRDF hopes this is just the start of a long awaited policy rethink by the Thai government to ensure migrants and other minorities groups living and working in Thailand gain human and social rights to which all peoples, regardless of nationality and immigration status, are entitled. This is in accordance with the Thai Constitution and international human rights standards.’

Free school for Burmese children in Mizoram

A free school has been opened for Burmese children living in Mizoram, in Northeast India on October 26. It has been named ‘Moe Toah Star’ (Dawn Star Donated Wisdom School) was sponsored by Freedom for Youth Organization in Aizawl city, Northeast India.

“Many Burmese people live in Mizoram state. They are from different parts of Burma. Some families come with children and they cannot afford to send them to school in India as they struggle for their livelihood. This school is mainly for those who cannot attend formal school,” said a source.

The school is located in Zuangtui block, Aizawl city. There are no other sponsors except Freedom for Youth Organization.

“The rent for the school is Rs.2000 per month and Rs.3000 is for teachers as monthly basic. Now there are a total 25 students and they are being taught Burmese, English and Mizo languages with the help of Wisdom School,” he said.

“Now we have only one teacher. We are still looking for Mizo and English teachers and we hope we will appoint them soon,” he added.

“We have to educate all our children. We are ready to work with other organizations and associations. At the same time we would like to help those who are facing various difficulties inside Burma and other parts of the world through education that will help us understand our international brotherhood,” he added.

“The children are our future. Although they try to settle in foreign countries they face many problems, especially in terms of language and educational background. Our organization can help them out of unwarranted situations,” he said.

Freedom for Youth Organization was established by only five people on 23 September 2009 in New Delhi, India and it was extended on 17 October to Aizawl, Mizoram state.

Phuket’s New Worker ID System a Fearful Failure

A SPEEDY reappraisal is required of the failing system that covers about 100,000 so-called ”alien” workers on Phuket – because most of them are not what they seem.

Thousands of people presumed to be Burmese, operating illegally on the island, mostly in unskilled construction jobs, have now actually been found to be ethnic Mon.

This means the attempt to register the majority and give them legal status could never have worked because Mon are not recognised as citizens of Burma.

The new cast on the illegals was revealed at a meeting last week of a special committee involving MPs, Labor Ministry officials and other experts from Bangkok.

They told Governor Wichai Praisa-ngob at Provincial Hall that Phuket’s labor issues were more dificult to resolve than in most situations, where people carried passports or other identification.

The head of the Construction Association of Phuket, Natcharin Yosangrat, said: ”Up to 90 percent of my workers are Mon. There are not as many Burmese workers on the island as we thought.”

Of his 157 workers, 147 are Mon. Those proportions are reflected at construction businesses all over Phuket, he said.

When a new and seemingly more acceptable registration plan was proposed earlier this year, Khun Natcharin registered all his workers.

As part of that process, the paperwork had to be sent to Burma, he said, and individuals had to return to Burma to be given a workers’ ”passport.”

”Even my 10 Burmese staff are not happy to return to Burma,” Khun Natcharin said. The workers fear they could be arrested and jailed, despite assurances from Burmese officials that the system would function fairly. It was also too costly.

The Mon, on the other hand, have no status in Burma and could not register under any conditions, even if they had the money to pay, Khun Natcharin said.

The Burmese and Mon both preferred to pay corrupt officials in Thailand rather than run the danger of arrest and imprisonment under the ”improved” legal registration system.

”Even those among my workers who have Ids are happy to pay to avoid problems,” Khun Natcharin said.

One of the Bangkok officials said it was clear that police needed to be invited to the next committee meeting on Phuket.

Over the past few months on Phuket, thousands of workers, illegal and legal, have been queuing at administration offices in the first part of the registration process.

The total amounted to 62,622 who were Burmese/Mon, the meeting heard.

But Ubon Choipat, of the Phuket Employment Office, said that only 722 had actually taken their new documents to Burma for processing, and none had had a response from Burmese officials.

The 722 were still waiting in Burma for the workers’ ”passports” that would make it plain that the system had the support of the Burma government, she said.

A Bangkok committee member said that throughout the whole of Thailand, 40,000 workers’ applications had been made in Burma and only 10 percent had been approved.

He said he and other committee members accompanied the first 200 applicants to Burma, crossing at Tha Ki Leg.

”The people arrived at 6am and by midnight, the documents had still not been properly checked,” he said. ”With about 100,000 Burmese/Mon on Phuket and thousands more in other provinces, including Ranong, Phang Nga and around Bangkok, the new process is clearly never going to work.

”It would take 10 years at least, or perhaps a lifetime, to process everyone at this rate.”

The committee had come to Phuket to find out why so few applications had actually reached the second stage of the approval process, that is, the applicants returning to Burma to register.

Now they know: it’s because they are Mon, an ethnic group that has no status inside Burma.

The farcical outcome of the new, improved official plan to register and tax all workers lends weight to the plan by some officials who have proposed a do-it-yourself island only system.

They believe Phuket officials should independently register workers, illegal and legal, so that they all pay taxes at least, to cover the cost of the stress they place on the health system.

Thai residents on Phuket now find themselves in long queues at public hospitals for treatment behind Burmese. Human rights bodies have criticised the suggestion of a two-tiered system where those who pay tax get speedier treatment.

Burmese/Mon labor has been used to reconstruct Phuket and Andaman coast buildings since the 2004 tsunami but Thailand’s treatment of immigrant workers is blemished by curfews and repeated arrests of workers, who are swiftly trucked back to the Burma border.

The 2008-2009 ”pushbacks” to sea of Rohingya boat people seeking work or asylum and the death of 54 Burmese in a Phuket-bound container truck in 2007 are also black marks on Thailand’s mixed record of dealing with immigration issues.

Eastern Burma: another Darfur?

New Delhi (Mizzima) –At least 75,000 people became refugees and more than half a million were internally displaced in eastern Burma in the past year, following increased militarisation, which strongly indicates crime against humanity comparable to the situation in Darfur, said a consortium of humanitarian assistance groups.

Thailand Burma Border Consortium (TBBC), an alliance of 12 aid organizations, in a new report titled “Protracted Displacement and Militarisation in Eastern Burma” released on Thursday said, threat to human security has been mounting as Burma’s ruling junta continues militarisation in areas of ethnic minorities.

“The process of militarisation has been on in Burma for decades, and this is the continuation of the tactics of controlling the population by moving the Burmese Army into these [ethnic] areas and taking control by moving people to relocation sites,” Sally Thompson, deputy director of the TBBC told Mizzima on Friday.

Thompson said, militarisation in ethnic areas have been continuing and is likely to further increase in the run up to the junta’s elections in 2010, as the regime pressurises ethnic armed rebels to transform into the Border Guard Force (BGF).

Since 1996, the TBBC said, over 3,500 villages, including 120 communities between August 2008 and July 2009, in eastern Burma have been destroyed and forcibly relocated.

The highest rates of recent displacement were reported in northern Karen areas and southern Shan State with almost 60,000 Karen villagers hiding in the mountains of Kyaukgyi, Thandaung and Papun Townships, and a third of these civilians fleeing from artillery attacks or the threat of Burmese Army patrols during the past year, the TBBC said in a statement.

In Shan state, a similar situation prevails with nearly 20,000 civilians from 30 Shan villages forcibly relocated by the Burmese Army in retaliation against Shan State Army-South (SSA-S), an ethnic Shan armed rebel group, in operations in Laikha, Mong Kung and Keh Si Townships.

In late August, conflict between Burmese Army troops and Kokang rebels in Northern Shan State forced over 30,000 Burmese refugees to flee to China.

Thompson said in July, a joint military campaign launched by the Burmese Army and its ally the Democratic Karen Buddhist Army (DKBA), against the Karen National Union (KNU), an ethnic Karen armed group, forced up to 4,000 people to flee to Thailand.

“We expect to see this pattern continuing in the ethnic and border areas as we approach the [2010] elections,” Thompson said.

The TBBC, which has been helping Burmese refugees since 1984, is currently providing food and shelter to more than 150,000 Burmese refugees living in nine camps along the Thai-Burma border.

With increasing conflicts in Burma and the arrival of more refugees, Thompson said these refugees will have no place to return until Burma has national reconciliation through dialogue.

Thompson added that the junta’s planned elections is unlikely to bring stability as it will have no credibility without the release of political prisoners including Aung San Suu Kyi and allow their participation.

But until there is any significant political change that can ensure the return of refugees and internally displaced people, the international community, particularly neighbouring Thailand should continue providing assistance including shelter and food.

The TBBC, which currently is supported by 15 donor countries, also urged the international community to increase their support as with the number of refugees arriving on the Thai-Burma border, and increasing prices, it is facing difficulties in consistently supporting the refugees.

The Burma Army is currently conducting attacks in Mone Township, Nyaunglebin District, Karen State. The operation began on 7 October. As of 9 October almost 1500 villagers had been displaced by the attacks. This report originally dated 23 October 2009.

The Burma Army is currently conducting attacks in Mone Township, Nyaunglebin District, Karen State. The operation began on 7 October as Burma Army Light Infantry Battalion (LIB) 599, Infantry Battalion (IB) 73 and IB 39 left Kwee Di Kaw and Maladaw camps and separated into at least two columns moving east. As of 9 October almost 1500 villagers had been displaced by the attacks.

On 7 October the Burma Army entered Nya Mu Ki village and shot Pastor Baw Pae, who was able to escape. On the same day, a different column shot and wounded Saw Hsaw Oh U, 35, from Kyauk Pya village. On 8 October, the Burma Army attacked Tanata village, burning down houses, including the house of Saw Poe Thaut Kya and all his belongings. On 9 and 10 October troops fired mortars on multiple villages in the Nwa Lay Ko, Giblayta and Saw Poe Ta areas. As the columns have proceeded thousands of villagers from Kyauk Pya, Nar Hti Ko, Nya Mu Ki, Taw Poe Hta, Thay Kay Lu, Hti Taw Ki, Nwa Hta, Nwa Lay Ko, Tanata and other villages have run under threat of attack and are hiding in the jungle. Schools in these areas have been closed. Food and medicine are scarce and many people, especially children, are sick. FBR teams also reported on 15 October that many villagers’ farms were being destroyed by wild animals because the villagers are hiding rather than tending their farms. The Burma Army has also been destroying rice fields in order to erect temporary huts for shelter.

People living in this area have faced other problems in the preceding months. On 6 September, LIB 563 forced Saw Tha Blar and Saw Pi Ti from Maladaw village to go to Htee Mu Hta camp to work without pay. Maladaw villagers were later forced on 10 September to build three security hits near the village. LIB 501 entered Kwee Di Kaw village and shot villager Saw Maung Pler, age 21, on 23 September. In addition, the Burma Army has been requiring each family in some villages to send someone to join ?Peace Group? militias, or else pay more than 150,000 Kyat. This has been compounded by natural disasters. FBR teams reported on 3 October that in the Ler Klah, Saw Ka Der and Hti Ler Baw Ta areas of Mone Township, up to half of the paddy farms in the area were destroyed by rats, creating a food shortage. Flooding on August 8 also contributed to a food shortage.

Increasing numbers of refugees crossing from Burma into Thailand have placed extra strain on a border clinic that treats thousands of Burmese each year, the director of the clinic said.

The Mae Tao Clinic, in Thailand’s border town of Mae Sot, is “struggling with a major funding crisis”, said Dr Cynthia Maung.

“This year, attacks on ethnic areas in Burma added even more patients to our ever growing caseload and forced a stream of displaced people, including orphans and unaccompanied children, over the border in search of food, shelter and education,” she said in an open letter.

Speaking to DVB today, she said that “around 99.9 percent” of patients were Burmese who are unable to find adequate healthcare in their own country.

According to medical aid group Medicins Sans Frontieres (MSF), the Burmese government spends an estimated $US0.70 per person each year on healthcare.

A World Health Organisation (WHO) report in 2000 ranked Burma’s healthcare system second worst in the world, one place above Sierra Leone.

“Each year the number of patients from Burma seeking treatment at the clinic increases by 20 to 30 percent,” said Cynthia Maung.

She added that the clinic’s child protection and education programme was also being put under strain as more young people crossed the border.

“Higher numbers are dropping out of school, and so have little chance to find employment and therefore come to Thailand,” she said.

“Also, a lot of children near the border are afraid of being recruited into the army so they try to get resettled in Thailand.”

A United Nations report released earlier this month found that education and health support in Thailand way surpassed that of Burma.

A person who is born in Thailand “can expect to live seven more years, to have almost three times as many years of education, and to spend and save eight times as much as someone born in neighbouring Myanmar [Burma]”, it said.

Heavy fighting in June this year between government troops and the opposition Karen National Union (KNU) forced around 5,000 civilians across the border into Thailand, many of whom found only rudimentary medical assistance in refugee camps.

The Thailand Burma Border Consortium (TBBC) warned yesterday of further unrest in eastern Burma in the run-up to elections next year. The Thai government has voiced concern about another wave of refugees crossing the border.

Hundreds flee homes in eastern Burma

Military offensives by the Burmese army against a Karen opposition group have caused “hundreds” of civilians to flee their homes in the past fortnight, a senior Karen official said.

Burmese troops have also been using Karen civilians as army porters, according to Karen National Union (KNU) joint secretary, Saw Hla Ngwe.

“Hundreds of locals have been displaced since the third week of October. Their farms, left unattended, have gone to waste,” he said.

There has been an increase in troop activity in Moe Oo and other townships under KNU control, he added.

The news follows a report released last week by the Thailand Burma Border Consortium (TBBC) that warned of increasing security threats in Karen state.

The destruction of some 3,500 villages by the Burmese army and proxy Democratic Karen Buddhist Army (DKBA) since 1996 was comparable to Darfur, the report said, “and has been recognised as the strongest single indicator of crimes against humanity in eastern Burma”.

The report also said that around 75,000 people in eastern Burma had been forced to flee their homes in the past year, while more than half a million remain internally displaced.

The Thai government is also said to be concerned about a possible increase in Burmese refugees crossing the border to escape fighting as the government prepares for elections next year. The Washington-based Refugees International (RI) warned last month that Thailand faces a “wave of refugees” prior to the elections.

In June this year around 5,000 Karen refugees crossed into Thailand to escape fighting, although many have since returned.

The conflict between the Burmese government and the KNU has stretched over six decades, and is thought to be one of the world’s longest running.

The DKBA, which split from the KNU in 1995, is alleged to be vying for control of Karen state in lieu of creating a black market trade zone.
