Govt urged to extend labour law to maids

Labour laws need amending to help 400,000 housemaids who are being neglected despite the huge economic contribution they make, a seminar has been told.
Sumet Ritthakanee, chairman of the House committee on labour, said housemaids were not adequately protected under the labour law.
Mr Sumet yesterday told a seminar on the rights of domestic helpers that many were subjugated and taken advantage of by their employers.
They have no access to state welfare even though they generate 27 billion baht for the economy each year, he said, citing estimates from the Kasikorn Research Centre.
He insisted the maids were fully entitled to better legal protection and welfare.
He said they were largely underpaid, face gruelling working conditions and, in some cases, suffer sexual harassment at the hands of their employers.
Mr Sumet said maids’ working conditions could be improved by amending laws related to the compensation and labour protection fund.
Bundit Panwiset, head of the foreign labour advocate network, said the government should amend the 1998 Labour Protection Act to give helpers better legal protection and allow them to acquire labour skills training.
Maids should have a safe and clean working environment, work no more than eight hours a day and no under-age helpers could be hired, he said.
Suchin Buakhao, a domestic helper for 10 years, said she worked 14 hours a day, seven days a week and was not paid whenever she took leave. “The work is very tough,” Ms Suchin said.
“I have to serve not only the employer’s house but also the house of his siblings. I wish I could have a day off.”
She earns 4,500 baht a month and buys most of her food and drinking water. Her employer gives her only rice to eat. When she is sick, she pays her own medical bills.
A Tai Yai ethnic maid, who declined to be named, said she had to put up with sexual harassment.
Her present employer pays her 2,500 baht a month. But she has no days off and gets abused when she asks for leave to see her relatives.

US to Malaysia: Stop Human Trafficking Quickly

KUALA LUMPUR — The United States welcomes Malaysia’s crackdown on human trafficking, but wants to see “results rather than rhetoric” before it can remove the Southeast Asian country from a blacklist, a senior official said Thursday.
Several alleged traffickers, including government officials colluding with them, have been arrested and charged in recent weeks after Malaysia was labeled one of the world’s worst offenders in a US State Department report released in June.
The prosecutions were “heartening,” Luis CdeBaca, a top State Department official, told reporters at the end of a three-day visit to Malaysia where he met with government officials and aid groups.
But “we are looking for sustainability. We want to make sure that cases are brought (to court) not simply in the interim period,” he said.
CdeBaca was appointed in May to head the Office to Monitor and Combat Trafficking in Persons, which coordinates US government activities in the global fight against human trafficking.
“We are looking at results rather than rhetoric,” he said. “We are heartened by the tone and desire of the (Malaysian) government to achieve results but in terms of having tangible results that is something we have to continue to discuss.”
The US report said Malaysia is a destination and source for women and children trafficked for the purpose of prostitution, and men, women and children used for forced labor. Many of the victims were brought from Burma.
CdeBaca said Washington wants to see sustained investigations and prosecutions throughout the year before making its final decision on whether to remove Malaysia from the list in its 2010 report.
This was the third time Malaysia has been singled out for its record on human trafficking. It was first included in the State Department blacklist in 2001 and again in 2007, but was removed last year. Fifty-one other countries are also on the list.
If a country appears on the list for two consecutive years, it can be subject to US sanctions.
CdeBaca said a team of American experts comprising an experienced federal prosecutor, FBI personnel and a victims’ specialist will travel to Malaysia in October to help train Malaysian counterparts in enforcement.
He also urged the Malaysian government to work together with NGOs in what he said was a fight against “modern slavery.”
Malaysia’s Home Minister Hishammuddin Hussein has said the government will do “whatever it takes” to stop the problem, but noted there were many hurdles including a porous border with Thailand.
Activists estimate that hundreds of thousands of people from Burma live illegally in Malaysia in addition to 140,000 legal Burmese migrant workers.

Refugees cross the Chinese border in droves following armed clashes in northern Burma.
HONG KONG—Thousands of refugees were flooding from Burma into China on Thursday after military clashes in Kokang, a majority ethnic Chinese region close to the southwestern province of Yunnan.
“I have just got back from the refugee camps in [Yunnan],” a netizen identified as modi7705 wrote on the popular Chinese Web portal Baidu.
“From time to time, some more people come into the camp after sounds of gunfire and they are beset with questions about the situation on the other side of the border,” he wrote.
“There are a lot of women and children, including a young woman who gave birth to her baby only four days ago. You can smell disinfectant everywhere. It’s not a very clean place. Everyone is sleeping on the floor.”
Official media reports confirmed online accounts of refugee camps near Yunnan’s Zhenkang city.
“[Burma] residents are flooding into Yunnan province in southwest China Thursday amid a domestic war, the provincial government said,” Xinhua news agency said in an urgent bulletin.
The U.S. Campaign for Burma (USCB) said “tens of thousands of ethnic people” had fled the region, as China’s Chongqing Evening Post reported that up to 10,000 refugees had arrived in the border town of Nansan.
Early August
Residents of the Burmese region of Kokang interviewed last week said the exodus from the region, where 90 percent of the population is ethnic Chinese, began early this month.
“The Burmese military government has prepared to attack Kokang several times, and a lot of Kokang residents have begun moving over the border back into China,” the resident said.
Ou Zhaobin, former editor of the Kokang government Web site, said most ethnic Chinese had already left Kokang, and that many Burmese also had gone to China in recent days.
“The disturbances started a few days ago. The hotels on the Chinese side around Nansan are all packed with people,” Ou said.
Employees who answered the phone at hotels and guesthouses around Nansan township near Yunnan’s Zhenkang city confirmed separately that they were all full of guests, and that the situation in the town was unstable.
According to Baidu poster Modi7705, at least four people were shot trying to cross the border, but it was unclear whether they had been killed.
“They have put up speakers and people are shouting things over them on this side of the border,” he wrote from a border region of Yunnan.
“We can’t hear anything properly inside the house, but it sounds like a leader trying to calm everybody down. Actually the organization is pretty good here. The refugees coming across the border are very appreciative of China’s abilities. They don’t believe that the Burmese army will dare to cross the border.”
“One Burmese woman asked me if the Chinese army had arrived at the scene. They are hoping China will step in and mediate the conflict. But I don’t really see what can be done other than diplomatic efforts, and taking care of the refugees,” he said.
Around 90 percent of Kokang’s population is ethnic Chinese, speaking a southwestern dialect of Mandarin. The region was turned into a special economic zone by the Burmese military government in recent years, by agreement with the local authorities.
A ceasefire agreement signed last year with Burma’s military rulers expires this year, and the apparent military action seems to have come in response to a splitting of the Kokang leadership.
“The Kokang organization split into two factions [Wednesday] morning,” regional military affairs expert Aung Kyaw Zaw said.
“Mainly the leadership split in two factions, but the armed forces are still under the control of [regional commander] Peng Jiasheng.”
Kokang, a mountainous region of 2,700 square kms, has a complicated history, changing hands from China’s Qing Dynasty to British rule, and then to an uneasy federal relationship with the Burmese junta.
The region is controlled by the Myanmar National Democratic Alliance Army (MNDAA), led by ethnic Chinese commander Peng Jiasheng, based in the border town of Laokai.
Fighting in Shan state
The city and administration have now been taken over by Peng’s former deputy Bai Souqian, Burmese sources in the region said.
Earlier this month, Human Rights Watch called on the Burmese junta to immediately end attacks against civilians after thousands were displaced in Shan state.
It said that the Burmese army had reportedly deployed battalions to clear civilians from large areas in central Shan state between July 27-Aug.1, burning down more than 500 houses as they attacked 39 villages in the area.
The New York-based organization said it believed the operation was part of an intensified campaign against Shan State Army-South, an insurgent group that operates in the area.

Clashes push more refugees to neighboring area

Today, many more refugees have been fleeing into China in order to escape clashes of the Burma Army and Kokang that have taken since this morning, according to sources.
The first shoot out was staged by the Kokang at about 07:00 at Mangpiang village, Laogai, which reportedly killed 3 Burmese soldiers and dozens of weapons were also seized by the rebel group, said a local resident who declined not to be named.
The fighting marked the very first time for the Burma Army and the Kokang since the latter concluded a ceasefire agreement with Rangoon in 1989.
“People were very shaken and just rushed to China when they heard the shootings,” he said.
However, people who do not possess Chinese ID cards were not allowed entry, except Chinese and Kokang, he added.
“Hundreds of Chinese policemen are guarding in front of the gate,” he said.
Thousands of people have already fled to Nan San (Nam Hsang in Shan) Township since Monday, when the Kokang issued a statement that “People have to be prepared all the time.”
According to the latest report, Peng Jiasheng’s faction was reported to have seized back their arms repair workshop which was raided by the Burmese Army on Monday night, August 24.
The two sides nearly came to blows with each other on 8 August when the Burma Army demanded to investigate reports of Kokang force having an arms factory. Since then, thousands of Burmese troops were moved into Kokang.
The Burmese military has been pressuring all ethnic ceasefire groups since April to transform themselves into a border guard force under the government’s control ahead of their elections planned for 2010.

Burma fighting raises civil war fears: analysts

Fighting between Burma’s junta and ethnic groups Friday raised fears of full-scale civil war and forced more refugees from the northeast across the Chinese border, media and analysts said.
A battle in Shan state between the Kogang rebel group and the government’s army began Thursday, breaking a 20-year ceasefire, according to the US Campaign for Burma (USCB), which uses Burma’s former name.
More than 10,000 refugees have crossed into the Chinese border town of Nansan in southwestern Yunnan province since August 8 and at least one Burma policeman was reportedly killed during the fight, the campaign group said.
“People say they have been hearing gunshots and explosions,” said Khuensai Jaiyen, editor of the Shan Herald Agency for News.
He said another ethnic group, the United Wa State Army, had now reportedly joined the Kokang forces’ fight against the junta and he warned that other groups currently under ceasefire agreements could join in.
“If the Burmese army is returning to a reconciliatory stance it might get better but if not it might be blown into a full-scale civil war,” Khuensai Jaiyen said.
He added that the government was trying to create stability ahead of elections scheduled in 2010 but warned “it will be the opposite”.
David Mathieson, a Burma analyst at Human Rights Watch, agreed full-scale civil war was “a very real fear”.
“This could potentially be the flash point that draws in several other groups to the resumption of open conflict,” he said.
Burma, under military rule since 1962, has signed ceasefires with 17 ethnic armed groups.
Chinese state media reported Friday, citing local officials, that Burma nationals were still crossing the border into Yunnan province, without giving a specific figure.
“It’s difficult to get a real-time update of that number,” Yu Chunyan, a spokesman for the provincial government, was quoted as saying in the English-language Global Times.
The newspaper reported that China had increased the number of armed police along the common border.
Refugees have been settled in a temporary camp, and Chinese officials were providing food and medical care, the state Xinhua news agency reported, citing unnamed provincial government sources.

Scorched earth victims ordered to rebuild houses

Villagers in Burma’s central Shan state whose houses were razed in the junta’s latest scorched earth campaign this month have been ordered by the army to rebuild their property.
Some 500 hundred houses were burnt down by the Burmese army near Laihka town in Shan state between 27 July and 1 August, uprooting around 10,000 civilians.
Sein Kyi, deputy editor of the Shan Herald Agency for News, said that army officials in the area recently ordered those who fled to return to their villages and rebuild their homes.
“They also shot video and picture footage of the villages being rebuilt to make it look like the army was actually helping the villagers.”
He said the villages were burnt down by army soldiers together with troops from a splinter group of the opposition Shan State Army, known as the Brigade 758.
“Now the army officials are telling villagers it was the Brigade 758 who burnt down their houses, despite warning [the brigade] not to,” he said.
“But actually, it was the [government] troops who burnt down the villages and the Brigade 758 was only accompanying them.”
The order to rebuild the villages follows a press conference held two weeks ago in Bangkok by Shan right groups, who reported that around 40 villages have been targeted in the campaign.
According to the groups, it is the single largest forced relocation in Shan state since a campaign from 1996 to 1998 saw the uprooting of 300,000 villagers, many of whom fled to Thailand.
Some aid materials, brought to the displaced by sympathisers in nearby towns and villages, were reportedly intercepted by the army on August 7.
Sein Kyi said that the materials were recently distributed to the villagers under the army battalion’s name.
Much of the scorched earth campaign has focused on Laikha township, where over 100 villagers, including women, have been arrested and tortured, and three have died. Many of these were displaced by the previous campaign.
