Thailand Re-opens Migrant Worker Registration Program

The Thai government has agreed to offer a new round of registration for work permits for non-citizens illegally working in Thailand, according to Thai non-government organizations.

Jackie Pollock, a founding member of the Thailand-based Migrant Assistance Programme (MAP), said the new registration process requires a recommendation from an employer. The registration process started on Monday.

Myo Thaw, a member of the Labor Rights Promotion Network (LPN), which is based in Mahachai in Samut Sakhon Province said that the new migrant work permits will have different colors to show the category of work.

A worker will have the right to change jobs, but it must be in the same field of work.

According to the LPN, there are 76,000 Burmese workers who have legal work permits and more than 224,000 workers awaiting a new registration cycle in Mahachai.
Meanwhile, the Thai government also has agreed to allow Burmese workers who now hold work permits to apply for work passports from Burma. About 500,000 people are legally registered to work with the Thai ministry of labor.

However, observers said many Burmese are hesitant to apply to the Burmese government for fear of being sent back to Burma.

MAP estimates that there are currently up to five million Burmese migrants living and working in Thailand.

Two mothers together with their babies arrested

Two Thai policemen raided the Burmese migrant workers’ residences around 9 am yesterday (June 3rd 2009). The police arrested two mothers together with their babies and the mothers were handcuffed. The incident happened in the Wathom area of Mahachai township near Bangkok.

“It was about 9 am when the two policemen came to this area by motorbikes to arrest the workers,” said Ko Win Zaw, a volunteer who is helping Burmese migrant workers in the Bangkok area.

“They arrested two mothers and their babies,” he continued, “the mothers were only 28 and 29 years old and their babies are about only three months old. Two other girls, a five year old and a seven year old who are believed to be the daughters of the detained were also arrested and the police brought both of them together with their mothers and the two babies. The mothers were handcuffed together, clasping their babies with the other hand over their breast. The two girls went along with their mothers, crying along the way.”

Most of the Burmese migrant workers in the Mahachai area are working in fisheries. According to Ko Win Zaw, the husbands of the female detainees are thought to have been fishing in the sea when the incident occured. The mothers together with their three month old babies and two daughters were still detained in a police cells in the Wathon area until yesterday afternoon when the news was reported. A witness said that nobody had come to meet the mothers and their children in the cell yet.

According to data from the Ministry of Labour in Thailand, over one million migrant workers from Burma are now working in Thailand, (according to the UN the number is over 2 million). Among them, over ninety thousands have been registered at labour offices to work legally in various sectors in Thailand. Forty percent of them are working in fisheries and trading, thirty percent are in agriculture and livestock and another thirty percent are working in various industries such as construction, rubber plantation, industries, domestic and others.

Four hundred migrant workers arrested

Four hundred migrant workers and their children were arrested by Thai border guards at around 3 am, yesterday morning. The Thai border guard soldiers raided the “44 Kilo Village” in Phuphaya townsip, south of Mae Sot on the Thai-Burma border. After they arrested four hundreds migrants, including children who are studying in school, the soldiers also burnt the houses, clothes and kitchen wares of migrants in the village who had managed to escaped arrest.

“They ran. The soldiers burnt about three or four houses and about thirty houses in the village were destroyed. They took all the chickens of the villagers,” said Ma Yin Win, a witness who escaped arrest.  ”The three 70-year old people,” she added, “including pregnant women with babies were also arrested. We’re anxious about so many difficulties. We moved to Thailand as it was too difficult for us even to survive in Burma. Thailand’s also not safe for us. We now have so many difficult situations.”

Htike Thu Aung, who is a teacher of migrant children in 44 kilo village, said, “All 120 children from kindergarten to grade five, studying in our school were arrested. They also arrested the people nearby my place. If they want to arrest the workers without work permit cards, ok, they can. Now, why did they even burn the houses of the villagers? The parents of a child from Kindergarten have work permit cards. The child was staying with his grandparents. The soldiers arrested the grandparents together with the child. The child’s parents begged them not to arrest their child but the soldiers did anyway. They even burnt the houses. They’re so cruel!”

The soldiers continuously carried all the arrested migrant villagers by truck from 3 am, early in the morning to 8 am. Last month, the same had happened in that village (44 kilo). The soldiers raided the village and expelled the villagers from the village. Since then the villagers had been hiding in the nearby forest for a month. Now, the soldiers have arrested them and burnt their houses down not long after they returned home from the forest due to it being rainy season.

“The reason for the arrests was not having work permit cards. We don’t understand Abhisit who said that Thailand fully respects human rights. All the workers, working in this area, are from Burma. They don’t get paid full wages. They get the wages from 60 Baht to 100 Baht (US$1.7 to US$ 2.8) per day. All the profits from the workers’ effort are just for Thailand. The Thai authorities should be sympathetic the workers whom they get the profits from,” said Ko Nyo Maung, a teacher in “44 Kilo Village.”

Ko Moe Gyo, the Chairman of Joint Action Committee for Burmese Affair (JACBA), said, “On the 28th of March 2009 the Thai soldiers raided “War Taw Village” which lies about 48 Kilometers from Phuphaya township. They burnt 80 houses and all the houses were destroyed. The villagers fled to the forest. We gave food and other necessary things to two hundred workers who had fled into the forest. The Thai government need to respect human rights as Thailand is a democratic country. It has said that over two million foreign migrant workers will be registered. They should wait until the registration period has finished before they arrest illegal migrant workers. If the workers have work permit cards, it will be good for their health and safety. They will be able to go out safely. However, the firm owners don’t want to help those workers who are working for them. Aside from the police and immigration officers, a Thai volunteer force also harasses the Burmese workers. We don’t like such an unfair behavior.”

According to migrant teachers and volunteers who are working in the “44 Kilo Village” area, the Thai soldiers raided the villages of Burmese workers and burnt their houses twice in 2008 and another twice in 2009, including this time.

Color-coded employment cards for migrant workers issued

Thai labor ministry has recently prescribed color-coded employment cards under the forthcoming registration for workers from Burma, Laos and Cambodia to differentiate the sort of their works, according to the daily Thai newspaper Khomchadleuk reported last week.

Colors described were:

  • Blue card will stand for fisheries
  • Green card – agriculture
  • Yellow card- construction
  • Orange card- seafood factories
  • Gray card- domestic work
  • Pink card – general

Workers holding pink cards are available to get access to 19 types of work, the report said.Even though migrant workers holding new registration cards will be allowed to work legally, they will be only appointed after Thai citizens fail to apply. But they will have the right to get access to the basic rights as Thai citizens.

On 2 June, Alien Employment Administration meeting (Kaw Raw Phaw) made up a new policy that job owners must give priority to Thai citizens allowing them 7 days to apply if there is a job vacancy.

The meeting also reached a decision to offer a new round of labor registration to new migrant workers and existing workers who previously lacked legal status.

“People who entered the country after the decision was made will not be allowed to apply for the registration. They will also be arrested and sent back,” labor minister Paitoon Kaewthong was quoted in the report.

During the registration period, border checkpoints would be strongly tightened to stop outsiders from coming to “seize the opportunity.”

He also said all work permit cards will be expired on 28 February 2010. After that employers must ask their workers to apply for passport document.

In Chiangmai province, the registration for the new workers will start from 1 July, a member of a right group said.

Bosses who are willing to appoint new workers can ask for quota at the Employment Department office, she said.

Now, workers holding current permits have been called upon to apply for another year of extension since early June. They were also required to apply for the nationality verification process at same time, according to a worker who was also required to submit the form.

People who pass the process of the nationality verification by their country will be allowed to work for another 2 years.

According to the report, about 500,000 migrant workers have registered with the labor ministry up to now. There are at least 2 million legal and illegal migrant workers in Thailand.

Mae Sot Workers Hungry for Suu Kyi News

MAE SOT – Factory workers along the Thai-Burma border are simmering with anger over the ongoing trial of Burma’s democracy leader Aung San Suu Kyi.

News of the trial has quickly spread through the factories and ignited quiet outrage amongst the workers. For many of the migrant workers, the Burmese government is to blame for the financial misery which has led them here to the factory floor. Their only hope for being able to return home is the release of Suu Kyi who could now face a further five years imprisonment.

like slaves in another country,” said a knitter in his early 20s in a textile factory. “If she is released, then she will be able to sort out all our country’s problems, and I can go home to my family.”

The workers are shocked by the news coming out of Burma but hardly surprised.

“I knew she was due for release soon so I expected the SPDC would do something,” said another worker from Pegu. “I am angry but because I am a migrant worker I feel so helpless.”

With so many counting on her, the present trial is a great concern for all the migrant workers who anticipate the day they can live and work in Burma.

Relieved from their eleven-hour shifts twice a day, most of the workers catch up on the news during their breaks.

In one knitting factory, workers watch the Democratic Voice of Burma TV in the canteen during lunch. Many of the factories have TVs, but they are often muted or playing Burma’s state channel-MRTV.

In the factories that don’t have TVs, the workers go to the tea shops in the factory compounds and get updates from the radio.

Most workers don’t listen to exiled media radio stations such as the BBC or RFA. Workers are attracted to the “good pop music” on Padauk Myay, a government-owned radio station in Rangoon. Airing at 5:30 am till 8 am, it is convenient for workers to listen to as they prepare for work.

Mae Sot-based organizations suspect it was designed to interfere with exiled media agencies’ programs. Radio listeners in Rangoon have reported Padauk Mayay radio interrupting BBC news programs and temporarily taking over the frequency.

Like all media in Burma the radio stations adhere to the junta’s policy. Although it has reported the Suu Kyi trial, a lot of the details are left out so workers must rely on colleagues who listen to international news for the whole story.

“Not every worker has access to international news,” said one worker. “Some of the workers who know the whole picture have been informing their colleagues who listen to the government radio stations.”

For the latest information many of the workers rely on the handful of organizations that were set up to improve the working and living conditions for migrant workers.

The Yaung Chi Oo Workers Association publishes a monthly magazine that is popular amongst the migrant community, and it has become a source that informs the workers about issues relating to Burma.

Similarly, the Overseas Irrawaddy Association looks after all migrant workers who come from the Irrawaddy delta region. Many of the factory workers frequent the office to get regular updates about the trial. The chairman, Saya Pu, once a student activist, also worked in factories before setting up the organization.

“I set up the organization not for my living but to tell the workers about human rights and democracy,” said Saya Pu. “I push them all to read the news as much as they can.”

Malaysia Secures Coast to Stop Human Smuggling

PUTRAJAYA, Malaysia – Malaysia is deploying helicopters, boats and an aircraft along its coast to catch a rising number of suspected illegal immigrants from Afghanistan and Pakistan, some of whom may have drowned during their perilous boat journeys.

But the saga of the South Asian migrants comes with a twist – they are not trying to enter Malaysia illegally. Instead they are leaving Malaysia illegally on small overcrowded boats to sneak into Indonesia, most likely en route to Australia where they hope to eventually get asylum, officials said in interviews this week.

Many Indonesians, who work here without permits or overstay their visas, also use the boats to exit illegally.

Since March, four boats with 114 Indonesians, 58 Afghans, 37 Pakistanis and three Iraqis have been caught trying to cross from Malaysia toward Indonesia, according to statistics from the marine police and the Malaysian Maritime Enforcement Agency. A request by The Associated Press for interviews with the detainees is being processed.

Maritime officials say it is hard to estimate how many have successfully completed the dangerous passage.

“This is a new trend to us in Malaysia,” Home Ministry Secretary-General Mahmood Adam told AP.

The prospective migrants are believed to pay human traffickers in their home countries, who arrange for them to come to Malaysia on valid tourist visas. Once here, they see the sights in Kuala Lumpur and surrounding areas before setting sail on an uncertain journey.

Mahmood said most of these people are middle-class with means to fund their journey. Many want to escape the war in Afghanistan and in Pakistan’s border region, and all are looking for a better life.

“They have money. They travel all over the world. So how to refuse their visa application? It’s very difficult,” Mahmood said.

In late April, a boat carrying a Pakistani family overturned, and only a 14-year-old boy survived. All six family members including his mother, siblings and uncles drowned.

The Pakistani Embassy said the family – in Malaysia on tourist visas – was on a legitimate pleasure boat trip but police are investigating whether they paid smugglers to take them to Indonesia.

Early Thursday, two boats with 32 illegal Indonesian immigrants capsized in choppy waters off southern Johor state, leaving one woman dead and nine missing, Johor marine police chief Mohamad Khamsani Abdul Rahman said. The 22 others, including a suspected boatman, were rescued.

A third boat sank last month, killing eight Indonesians.

First Adm. Ahmad Puzi Abdul Kahar of the Malaysian Maritime Enforcement Agency said coastline surveillance was stepped up after the first tragedy in March.

He said an aircraft, helicopters and boats patrol the coast, and officers from all agencies are gathering information from fishermen and other locals about illegal vessels.

For now the human trafficking syndicates seem to have been intimidated and their activities have decreased, but policing peninsular Malaysia’s 1,073-mile (1,727-kilometer) long coastline remains difficult.

“The issue is like a balloon. When you tighten here, they will go to the other side … Of course we have to tighten (security) everywhere,” Ahmad Puzi said.

On May 28, a wooden boat packed with Afghan migrants sank off western Indonesia, killing at least nine people and leaving 11 others missing. The Afghans, who were rescued, told Indonesian authorities they flew from Afghanistan to Malaysia, where human traffickers offered to help them get by boat to Australia.

Capt M. Karunanithi, a senior official with the Malaysian maritime agency’s crime investigation department, said the migrant flow increased when Australia eased immigration restrictions last year.

He said among the Pakistanis and Afghanis arrested in Malaysia were two doctors and an information technology specialist, and many carried between $3,500 and $4,000 cash on them. Some told their interrogators they had relatives in Australia, Karunanithi said.

Those arrested have been jailed up to six months for exiting Malaysia illegally before being deported, he said.

Six people killed and others injured in truck accident

A truck loaded with twelve Burmese migrant workers, had an accident at 4 am on the 2nd of June, 2009. The truck crashed into a six-wheeled truck and overturned near mile post number 15 near the Chainat area, Tumbon Prasriracha township of Kanchanaburi Province, Thailand.

The accident killed five workers on the spot and another injured one died as soon as he arrived at the hospital. Some other injured workers in the accident are under the treatment of the intensive care unit at Sanglauri Hospital. Other workers who had minor injuries are being taken to the police station of Sanglaburi township, Kachanaburi Province as soon as they are discharged from the hospital.

The police officer from the criminal department of Sanglaburi police station said, “The truck crashed into a six-wheeled truck. We don’t know who the driver was. He escaped. We’ll deport all the injured workers to the border when they completely recover. We don’t have the right to arrest the foreign migrant workers who don’t have a stable job. The Thai government has recently coded a regulation to deport them all to the border.”

A nurse, who was on duty at the hospital, said, “The five dead bodies of female Burmese workers were brought to the hospital. The two male workers were seriously injured and one died in the intensive care unit while receiving special treatment. The last one, who’s still alive, is also in serious situation. He’s still in a coma. In total, five women and one man have died.”

“I don’t know where the other victims are from,” said the neighbour of the three victims, “but one of them stayed near me. One lived in Kawtalay village, Kawgraid township and she was 22. Another two were aged 23 and 29. They smuggled into Thailand through brokers. The driver who brought the dead bodies to the hospital told me to come and collect the dead bodies. How can we afford to pay for the funeral of the victims?”

The number of Burmese migrant workers smuggling into Thailand through Thai-Burma border, are increasing because of their country’s downturned economic situation under the military regime’s domination of the country. The severity of the smuggling racket made international headlines in April last year when 54 Burmese suffocated to death in the back of a truck while on their way to Phuket. Some workers died on the trucks in check points when the police poked sharp iron rods into the surface of vegetables under which the smuggled workers were hiding. Some migrant workers were killed by the Thai gang stars, Thai police and village authorities.

Thailand: Submission Of ILO Complaint Regarding Systematic Discrimination Against Burmese Migrants In Thailand

Mr. Sawit Keawan, General Secretary of Thailand’s State Enterprise Workers Relations Confederation (SERC*), today, file a complaint with the International Labour Organisation (ILO) during the 98th International Labour Conference in Switzerland. This complaint alleges that the Royal Thai Government (RTG) is breaching the ILO’s Equality of Treatment (Accident Compensation) Convention (C-19) by denying Burmese migrant worker access to the Social Security Office’s (SSO) Workmen’s Compensation Fund (WCF) following accidents at work.

On 4th December 2006, Nang Noom Mae Seng, a 37-year old Shan migrant worker from Burma, was left paralysed after being struck by a 300 kilogram mould at her worksite. Her official compensation claim was rejected by Thailand’s SSO. This was because she could not satisfy conditions for access to the WCF laid down in a 2001 SSO circular, requiring that: (1) Workers must possess a passport or alien registration documents; and (2) Their employers must have paid a dividend into the WCF. These conditions make it generally impossible for Burmese migrants to access the WCF.

The system for importing workers from Burma into Thailand continues to be a failure because of disagreements between the two Governments on verifying nationality of Burmese migrants already in Thailand. So Nang Noom and most of the other two million Burmese migrants in Thailand originally entered without documents. But over 500,000 of these workers have obtained a residence certificate and work permit allowing them to work ‘legally’ in Thailand. The problem is that the SSO refuses to accept these documents to meet requirements to gain access to the WCF.

There appears to be another double standard between Thai and migrant workers. The SSO prohibits employers of migrant workers from paying dividends into the WCF. Yet at the same time, regulations say that it is the responsibility of all employers who have one or more ‘workers’ to pay these dividends, and that it is the duty of the SSO to enforce this regulation. So when the employer of Thai workers fails to pay such dividends into the Fund and then one of their Thai workers has an accident, the SSO makes that employer pay retroactively into the Fund, and then Fund can then pay compensation to the victim directly. But for the injured migrant worker, this is not allowed.

As almost all migrant work accident victims in Thailand cannot satisfy conditions to access the WCF, their employers must pay them compensation directly. The problem is this creates the opportunity for employers to evade taking responsibility. As a result, many employers do whatever they can to avoid compensating their injured migrant worker. Thailand has thus created an informal system for compensating migrant work accident victims that results in the effective denial of access to compensation. Only in the most rare cases, where the injured migrant worker receives extensive legal and other assistance from a labour union, NGO or other group, does the migrant worker have a possibility of getting compensation. So there is a difference in treatment between ‘workers’ on the basis of nationality, and this is clearly discriminatory.

As a result of this systematic discrimination against Burmese migrant workers, the RTG is failing to adhere to ILO Convention 19 which requires equal treatment regarding work accident compensation between nationals and non-nationals. SERC is therefore beginning to utilize the ILO’s supervisory mechanisms as part of continued attempts to convince the Ministry of Labour (MoL) to cease denying these fundamental rights to vulnerable migrant workers.

SERC has pressed senior MoL officials to address the fact that Burmese work accident victims rarely receive adequate compensation, but the MoL has ignored our requests. Three court cases have been filed against the SSO, but Thailand’s courts have been unable to deal with them. The National Human Rights Commission of Thailand has issued recommendations, which were ignored by the MoL. Finally, in March 2009, international complaints were submitted alleging violations of the UN Convention on Elimination of Racial Discrimination.

Despite all these efforts by SERC and our networks in Thailand, millions of Burmese migrant workers continue to be denied official work accident compensation.

This example of discrimination that SERC highlights today is just one of many experienced by migrant workers in Thailand, who work hand in hand with Thai workers to develop the Thai economy. Instead of integrating foreign workers into our society, the RTG continues to deny them fundamental rights in many parts of their lives.

The predatory policies of the Burmese military have already created an environment of repression and economic deterioration that force millions of Burmese to seek refuge and a better life in our country. These workers have faced abuses enough already and must not also be denied rights under ILO Convention 19, which has been ratified by Thailand.

In an era of global migration, international labour standards must be enforced in migrant receiving countries to ensure migrants work in acceptable conditions. The ILO Declaration on Fundamental Principlesand Rights at Work proclaims ‘the ILO should give special attention to the problems of migrant workers.’ The ILO Constitution also provides that if any of the ILO’s member states fail to secure effective observance of a Convention to which they are party, worker organisations can take this non-compliance to the ILO’s Governing Body.

Thailand’s refusal to respect ILO Convention 19 should now be brought before the ILO’s Governing Body. This should provide additional pressure on the RTG to remove obstacles unfairly faced by Burmese migrants seeking access to work accident compensation. The ILO must also keep continued failings by the Burmese junta at the top of its agenda, as this is the root cause of an increasingly irregular migration flow from Burma into Thailand.

Karen villagers flee to escape battlefront

Chiang Mai (Mizzima) – Several hundred ethnic Karen have crossed into Thailand as fears of fresh fighting between the Burmese Army and the Karen National Liberation Army (KNLA) echo along the border.

Colonel Phadung Yingpaiboonsuk, Commander of the 4th Infantry Division of the Thai Army, has ordered military and administrative officials in Tak Province on the border of Karen State to look after 16 families, a total of 85 people, newly arrived in the Kingdom as asylum seekers. They are currently staying at Thammajarik Monastery and being provided with food and medical care in addition to 24-hour security.

The Thai Army is also preparing an emergency plan for local Thai villagers in case the fighting spills over the border.

Other groups of Karen are reportedly sheltering in the villages of Tungtham, Nong Bua, Mae Salid and Mae Usu after hearing that Burmese Army and Democratic Karen Buddhist Army (DKBA) forces are preparing to attack the KNLA’s 7th Brigade near Thasongyang District, west of Thailand. The battleground is a mere three to four kilometers from Thai territory.

An official in Tak Province revealed that the Thai military has reinforced its troops along the border with Karen State after fighting between the KNLA and Burmese Army affected local villagers in the area.

“The villagers have crossed the Moei River by long-tail boat at several points in Tak Province’s Thasongyang District. Thai authorities will take care of them and provide humanitarian aid. However, it is possible that the fighting will become more serious,” according to a report in the Thai newspaper Matichon on Friday.

The current military campaign kicked off in April of this year, pitting the Burmese Army and its ally the DKBA against the KNLA, the armed wing of the Karen National Union. The Burmese Army previously burnt down several buildings in Wah Lay Kee Refugee Camp after overrunning the base.

In April, the Thai Army twice submitted a Memorandum of Understanding in protest against the Burmese Army for discharging mortar fire that landed in Tak Province, injuring two Thai soldiers.

Additionally, about 200 Thai villagers from Phadee were temporality relocated for several days deeper inside Thai territory out of concern for their safety. Local authorities have since found a number of unexploded ordinances, including landmines, left in the village as a result of the fighting.

Over 700 villagers flee to Thailand amidst fears of SPDC/DKBA attacks on a KNLA camp and an IDP camp in Pa’an District

 

Villagers in Pa’an District, Karen State, have begun fleeing to Thailand to avoid violence and forced recruitment as porters in possible a joint SPDC/DKBA attack on a KNLA camp in Dta Greh Township, located next to a now populous IDP camp along the Moei River, bordering Thailand. This news bulletin describes the events of the past four days in which SPDC and DKBA forces have advanced towards the KNLA camp and begun what appears to be preparation for an attack. SPDC soldiers have begun patrolling and have set up an 81 mm mortar not far from the site and displaced villagers living in the area have become increasingly concerned about their safety.

As of Friday, June 5th 2009, over 700 villagers from Dta Greh Township of Pa’an District, Karen State, have fled to Thailand in order to avoid fighting between joint State Peace and Development Council (SPDC) / Democratic Karen Buddhist Army (DKBA) forces and Karen National Liberation Army (KNLA) soldiers. In total around 250 soldiers from SPDC Light Infantry Battalions #202 and 205 and Infantry Battalion (IB) #81 and DKBA Brigade #999 have advanced in what appears to be preparation for an attack on KNLA Battalions #101, 21 and 22. Such an attack would fit the wider pattern of SPDC/DKBA operations against KNLA positions throughout Pa’an and Dooplaya districts in the lead-up to the 2010 elections in Burma.

On June 1st 2009, DKBA soldiers from Brigade #999 began arresting villagers in T’Nay Hsah Township to serve as porters carrying supplies in upcoming military operations. KHRG field researchers have reported that 50 villagers from the area fled to Thailand on June 1st in order to avoid this forced labour as military porters.

Later the same day, SPDC LIBs #202 and 205 and IB #81 along with soldiers from DKBA Brigade #999, led by battalion commander San Bpyot, advanced to an area in Dta Greh Township located about a one to two hour walk away from a KNLA camp. Previously, the SPDC had a single battalion stationed at this site which remained in the camp without patrolling. DKBA #999 earlier had about 10 soldiers stationed in the area. However, with the recent advance, the numbers of both SPDC and DKBA soldiers in the area have increased. The SPDC has also begun patrolling the area and the DKBA has started sending in rations in increased amounts.

The KNLA camp housing Battalions #101, 21 and 22 is located near to Ler Per Her, a large camp for Internally Displaced Persons (IDPs) along the Thailand border. This camp now has a population of over 1,200 people, mostly comprising villagers who previously fled attacks and abuse elsewhere in Pa’an District. The recent advance appears to indicate a possible coming attack by the joint SPDC/DKBA forces on the KNLA camp. Upon arrival, around 200 soldiers from four columns of SPDC LIBs #202 and 205 began patrolling around Gklay Moh Kee, Gklay Poh Kee, Mae Lah Ah, Mae Lah Ah Kee, See Poh Kee, Htee Gkaw Haw and Wah Mee Gklah villages, all of which lie in Wah Mee Gklaw village tract, Dta Greh Township. Subsequently, on June 2nd 2009, residents from at least some of these villages began fleeing to Thailand (located about a one hour walk away) as they feared that if the attack occurred soon, they would be used by the SPDC and DKBA soldiers as porters or minesweepers.

On June 2nd and 3rd, KNLA soldiers launched two guerrilla-style attacks on the SPDC troops and planted landmines near to the area where the SPDC soldiers were patrolling. According to reports, eight SPDC soldiers were injured and five SPDC soldiers killed in the KNLA attacks. Then on June 4th, KNLA soldiers again attacked the SPDC troops.

As of Friday, June 5th 2009, KHRG field researchers reported that over 700 villagers had fled the area. This includes 132 people from 21 households in See Poh Kee village; 277 people from 46 households in Mae Lah Ah Kee village; and 312 people from 44 households in Mae Lah Ah village; all of whom have arrived at Oo— village in Ta Song Yang District of Tak Provice, Thailand. Villagers who have fled from the other four villages located near to the SPDC patrols include residents of Wah Mee Gklah who have taken refuge at T— village, also located in Ta Song Yang District.

On June 3rd, a DKBA officer from Brigade #999, who was operating with the SPDC soldiers, telephoned one of the village secretaries who was amongst those who had fled and urged him and fellow villagers to return to their homes in Dta Greh Township. The officer said that the DKBA would protect the villagers from abuse by the SPDC. However, KHRG field researchers report that the villagers remain wary of returning because they have had experience with abuse by DKBA soldiers in the past. Local KNLA soldiers reportedly told the displaced villagers they did not know whether or not the DKBA would honour its promise to prevent SPDC abuse or instead arrest those who returned and make them serve as porters. KNLA soldiers further warned that if the villagers were arrested and used as porters in an attack on the KNLA camps in Dta Greh Township, they would risk injury or death from the landmines which the KNLA had earlier deployed.

On June 4th, KHRG field researchers reported that the SPDC soldiers had set up an 81 mm mortar at the top of Bpoo Loo Dtoo hill, which is located above the KNLA camp and about five kilometres (about 3 miles) from Ler Per Her IDP camp in Dta Greh Township. Five kilometres is just within range of an 81 mm mortar. Villagers living in Ler Per Her IDP camp are thus increasingly concerned about their security and some have begun heading to Thailand for safety in case there is an attack on the site.

Attacks on KNLA Continue

The Burmese army and the ceasefire Democratic Karen Buddhist Army (DKBA) are shelling the main base of Brigade 7 of the Karen National Liberation Army (KNLA) with long-distance mortars, according to Karen sources.

Karen relief and human rights organizations said that the Burmese army and DKBA troops have started advancing on the Brigade 7 base following a long-distance attack on KNLA Battalion 21 that began at 1 am local time today.

A new offensive by pro-junta forces that began on June 1 with an attack on KNLA Brigade 6 has displaced more than 2,000 people, forcing many to flee to Thailand, according to Karen aid groups.

David Takapaw, the vice-chairman of the KNLA’s political wing, the Karen National Union (KNU), said that the DKBA was recruiting about 20,000 troops to launch more attacks.

He added that the current offensive appeared to be aimed at eliminating KNLA bases along the Thai-Burmese border ahead of a push by the Burmese junta to establish a new border security force consisting of DKBA troops under the command of the Burmese army.

The recent attacks were being launched by Burmese battalions under Light Infantry Division 22 and DKBA Battalion 999, according to the KNU.

Karen refugees are now staying in Ta Song Yang District in Thailand’s Tak Province, according to the Karen Human Rights Group (KHRG).

Poe Shen, a field director for the KHRG, said the fleeing villagers include residents of the villages of See Poh Kee, Mae Lah Ah Kee and Mae Lah Ah in Pa-an District.

Poe Shen said it was risky for Karen refugees to stay in a camp for internally displaced persons in Ler Per Her, on the Thai border, because the camp is located near KNLA Battalions 101, 21 and 22. The camp houses more than 1,200 people from Pa-an District.

In response to the offensive, KNLA soldiers launched two guerrilla-style attacks on Burmese troops on June 2-3 and planted landmines. Five Burmese soldiers were reported killed and eight injured in the attacks, according to a KHRG report.

FBR REPORT: Thousands of Refugees Flee Ler Per Her Camp as Burma Army Attack Begins

Karen State, Burma 6 June, 2009

Some 3,295 people have fled Ler Per Her camp as Burma Army and Democratic Karen Buddhist Army soldiers started the bombardment of the camp at 11.30am on June 6.

Hundreds of soldiers surround the camp which is on the Thai/Burma border north of Mae Sot and refugees are crossing the border into Tha Song Yang district in Tak province, Thailand, to escape the attack. Those in the camp had already fled attacks from the Burma Army in eastern Karen State numerous times and had established homes there, which now have to be abandoned.

Since October 2008 over 60 families have arrived in Ler Per Her, 40 of those from within the last week from Htee Per village. They fled because of Burma Army/DKBA activity and because the Burma Army was looking to recruit over 800 soldiers from the area. Soldiers have already arrested and forced villagers from Pa-an District and Myawaddi Township to porter supplies for this campaign. The attack is being led by Light Infantry Battalions 81, 201, 202 and 205, supported by some 300 soldiers from DKBA 999.

Those who have fled across the border are in Mae U Su, Noh Bo and Mae Salik and are in urgent need of shelter, medical assistance, food and clothing. An FBR team in association with Partners Relief and Development are bringing desperately needed supplies. So far PRAD has delivered 30 pots, 25 large tarps, mosquito repellant, food, rolls of plastic sheeting, two trucks of clothing and medicines for 200 cases of each of the following illnesses: malaria, diarrheal diseases, respiratory illnesses, wound care and painkillers. The leader of the camp confirmed that women and children had left the camp by June 5 leaving the older people and men. He asked for prayer for his people.

178 Burmese Muslim Pushed Back to Burma in 4 Days

By Tun Kyaw, Coxs bazar: Within four days 178 Rohingya Muslims from Burma who entered Bangladesh illegally were arrested and pushed back across the border to Burma by Bangladesh authorities, a source reports.

The individuals were arrested by Bangladesh Rifles Battalion No. 17 in the area of Bangladesh’s Ukia Sub-division under Cox’s Bazar District on the border of Maungdaw Township in Arakan State as they attempted to enter Bangladesh illegally to seek refuge.

Many Rohingyas were arrested on a bus in an area of Phalaung Khali while another 25 were arrested on a bus in the area of Balukhali in Ukia Sub-division, on the Teknaf – Cox’s Bazar highway last Wednesday when authorities set up checkpoints for buses traveling that route.

Rohingyas from Burma have been illegally entered Bangladesh in groups one after another over the last month. “The flow of Burmese Muslims into Bangladesh has been unabated,” said a border security officer on the condition of anonymity.

Local newspapers claim that Burmese entering Bangladesh are mixing into populations in the Chittagong Hill Tracts and causing crime and social unrest.

Due to the increasing numbers of Rohingyas fleeing Burma and entering Bangladesh, a committee comprised of 17 government departments was formed to prevent an influx of Rohingyas from Burma, said an official report.

As of Saturday June 6th, over 3,000 villagers have fled the area of Ler Per Her IDP camp in Dta Greh Township, Pa’an District to seek refuge in neighbouring Thailand. This includes villagers fleeing joint SPDC/DKBA attacks against the KNLA as well as those fleeing forced recruitment as porters to carry supplies for SPDC and DKBA troops engaged in the fighting. This is the largest refugee exodus from Karen State on a single occasion since 1997. Also, more refugees are expected as joint SPDC/DKBA forces have advanced towards the camp of KNLA Battalion #202, about 30 kilometres north of Ler Per Her.

On June 5th 2009, KHRG reported that over 700 villagers had fled to Thailand between June 2nd and 5th in order to avoid forced labour carrying military supplies for joint State Peace and Development Council (SPDC) / Democratic Karen Buddhist Army (DKBA) forces in an attack on a Karen National Liberation Army (KNLA) camp.[1] This KNLA camp is located near to Ler Per Her camp for Internally Displaced People (IDPs) in Dta Greh Township, Pa’an District. At the time, displaced villagers residing at Ler Per Her had already begun to leave in expectation of the coming SPDC/DKBA attack. By the end of June 5th, the entire civilian population of Ler Per Her had fled to Thailand.

Subsequently, on Saturday, June 6th, according to KHRG field researchers operating in the area, SPDC soldiers from Light Infantry Battalions #202 and 205 and Infantry Battalion (IB) #81, under Light Infantry Division (LID) #22, along with DKBA soldiers from Brigade #999 began attacks on KNLA Battalions #101, 21 and 22, of Brigade #7, based near to Ler Per Her IDP camp. At approximately 1:00 pm on June 6th, SPDC soldiers located atop Bpoo Loo Htoo hill overlooking both Ler Per Her and the KNLA camp, began shelling the KNLA camp with multiple 81 mm mortars. Then at about 3:40 pm, the SPDC and DKBA soldiers advanced in a ground attack on the KNLA camp. The Dta Greh Township chairperson, himself a local villager, has estimated that over 900 combined SPDC and DKBA soldiers are involved in the current attacks. At around 6:00 pm the same day, the fighting died down somewhat but occasional rifle shots continued. On the morning of Sunday, June 7th 2009, local KHRG field researchers reported that fighting had resumed in the Ler Per Her area.

Including those villagers from the surrounding area, over 3,000 refugees have now fled to avoid the attacks as well as forced labour carrying military supplies for SPDC and DKBA soldiers. This is the largest refugee exodus from Karen State on a single occasion since the SPDC’s massive 1997 offensive in Dooplaya District further south. The villagers from Ler Per Her and the surrounding area are now taking refuge at numerous areas in Tha Song Yang District of Thailand’s Tak Province. As many villagers have fled to different locations, KHRG field researchers operating in the areas do not yet have the exact number of refugees from some of the abandoned villages. Available numbers of the people and households from Ler Per Her and nearby villages who have recently fled to Thailand are indicated in the table below.

Other sources reporting the recent displacement have cited similar figures. According to the Karen-language news agency Kwekalu, more than 3,400 villagers have fled to Thailand from the area and have taken shelter at Htoo Hta, Mae Ploo, Au Thoo Hta and Mae Salik.[2] The Free Burma Rangers have reported that 3,295 villagers have fled to Thailand from the Ler Per Her area and have taken refugee at Mae U Su and Noh Bo as well.

Meanwhile, as attacks and displacement in the Ler Per Her area continue, combined soldiers from DKBA Brigade #555, under the command of Bya Bya, and SPDC LIB #201, also under LID #22, have advanced towards the camp of KNLA Battalion #202, which is located along the Moei River bordering Thailand, about 30 kilometres north of Ler Per Her. Expecting that the joint SPDC/DKBA forces will soon attack this area as well, residents of nearby Kler Khah, Htee Khoh Kee and Meh Gkreh villages began leaving for Thailand on Sunday, June 7th. A KHRG field researcher operating in the area has reported that those who have not yet left these villages are planning to flee shortly.

As it is now rainy season, these refugees, including many women and children, face serious humanitarian concerns and are in urgent need of support including blankets, mosquito nets and plastic tarpaulins. They lack sufficient shelter, food and heath provisions and schools have had to shut down. Local groups have already provided some assistance, but this has been limited. The Karen Refugee Committee (KRC) has provided about a week’s worth of food aid, but as more refugees arrive, this aid will have to be spread between larger numbers of people. The international community must not continue to neglect the ongoing humanitarian and human rights crisis in these areas.[4]

Burma’s Karen flee army offensive

About 3,000 ethnic Karen villagers have reportedly fled from Burma into Thailand in recent days because of a new Burmese military offensive.

Aid groups say the refugees are from Ler Per Her camp in eastern Karen state, near where the Burmese army is reported to be attacking Karen rebels.

It is thought to be one of the largest movements of refugees across the Thai-Burma border in a decade.

Meanwhile Burma still faces pressure to halt Aung San Suu Kyi’s trial.

The pro-democracy leader is charged with breaching the terms of her house arrest, a charge that could leave her in jail for up to five years.

Former Singapore Prime Minister Goh Chok Tong visited Burma on a “goodwill trip” on Monday, as international anger against the regime continued to mount.

‘Largest exodus for a decade’

The Free Burma Rangers aid group said refugees began streaming out of the Ler Per Her camp on Friday and continued to arrive in Thailand throughout the weekend.

The Karen Human Rights Group, a Thai-based humanitarian group, put the number of refugees at about 3,000 – and so too did a Thai army official speaking to local media.

The Burmese government has refused to comment on these reports.

The Karen Human Rights Group said the influx was “the largest exodus from Karen state on a single occasion” since the government launched a major offensive against the Karen rebels in 1997.

The refugees are now taking shelter about 100 km (62 miles) north of Mae Sot, a Thai border town.

The rights group Christian Solidarity Worldwide and other organisations have called on the United Nations to intervene to prevent a humanitarian crisis along the border.

Rebels from the Karen National Union (KNU) have been fighting for greater autonomy from Burma’s central government for more than half a century.

But the KNU is weakening under the impact of continued army offensives, as well as divisions within its ranks and with other Karen groups.

Another group, the Democratic Karen Buddhist Amy (DKBA), made a pact with the Burmese government and is reportedly now involved in the current fighting on the government side.

Clashes Force More Karens to Thailand

Ongoing attacks by a joint force of Burmese army and breakaway Democratic Karen Buddhist Army (DKBA) troops against the rebel Karen National Liberation Army (KNLA) Brigade 7 in southern Karen State have resulted in more than 3,500 Karen villagers from Pa-an District fleeing to Thailand since June 1 without sufficient food, shelter, clothing or medical care.

Emergency assistance for the new wave of Karen refugees is urgently needed, said Karen relief groups.

Several observers have said that the recent wave of attacks against the Karen rebels could be part of a strategy to divert attention from the ongoing trial of pro-democracy leader Aung San Suu Kyi in Rangoon. Others have speculated that the skirmishes are a belligerent response to the Thai government because of its public criticism of Burma’s handling of Suu Kyi’s trial.

Battalions of the DKBA and the Burmese army, also known as the Tatmadaw, have been reinforcing their troop numbers since early June and it is now estimated that about 9,000 armed soldiers-including an unknown number of porters-have amassed in strategic areas of Karen State in preparation for further military operations against KNLA Brigade 7, according to Karen sources.

Kavi Chongkittavorn, a columnist with the Bangkok-based English newspaper The Nation, reported on Monday that the ongoing attacks against the KNLA near the Thai-Burmese border were “timed to create chaos among Thai decision-makers,” perhaps indicating that Thai policy makers would be kept busy with the influx of Karen refugees on Thai soil.

In its current position as chairman of the Association of Southeast Asian Nations, Thailand had rebuked the Burmese junta for its trumped-up charges against Burmese opposition leader Suu Kyi. Burmese state-run newspapers angrily responded by accusing the Thais of interfering in Burma’s internal affairs.

The Nation columnist added that the military onslaughts also seem to have been designed to “drive a wedge in Thai-Chinese cooperation on Burma.”

Food, shelter, clothing and medical treatment are urgently needed as the Karen refugees could carry few belongings and are camped in the rain on the banks of the Moei River, with no proper shelter and little food. Some refugees are now hiding in jungle and will be at higher risk of diseases such as malaria as the rainy season commences.

Joint secretary 1 of the KNLA’s political wing, the Karen National Union (KNU), Maj Hla Ngwe, said that the offensive may be a part of a Burmese regime reaction to annoy Thailand.

He said the offensive is a signal that the Burmese regime does not seriously want to negotiate with the KNU and sign a ceasefire agreement.

David Thakapaw, the joint-secretary of the KNU, said the offensive was a smokescreen to divert world attention from the trial of Suu Kyi.

He concurred that the offensive was an indication that the Burmese regime does not want to talk about a ceasefire with the KNU.

However, Thakapaw said that the KNU was ready to fight against the Burmese army if the regime does not want to talk about a ceasefire agreement with the KNU and establish national reconciliation.

In April, Thai Foreign Minister Kasit Piromya passed on a message to KNU leaders reportedly sent by Burmese Prime Minister Gen Thein Sein that Burmese authorities wanted to negotiate with the KNU.

After meeting with the Thai foreign minister, KNU leaders reported to Kasit that they had agreed to meet with the junta’s representatives.

However, there has been no further contact from the Burmese authorities since then, according to KNU sources.

Htay Aung, a Burmese researcher with the exiled Network for Democracy and Development, said the offensive would appear to be part of the Burmese regime’s military activities to pressure the KNU to disarm.

“The Burmese regime does not want the KNU to be stable, because they think that the KNU is the leading player among the Burmese opposition groups in exile. So, they are always trying to destroy the KNU in any way they can,” he said.

According to Karen human rights and relief groups, clashes between the armed factions occurred throughout the weekend of June 6-7, but started during the first week of May.

Poe Shen, the field director for the Karen Human Rights Group, confirmed that an estimated 3,500 Karen refugees had fled their homes and are now staying in Tha Song Yang district in Thailand’s Tak Province.

Saw Steve, of the Karen relief group Committee for Internally Displaced Karen People, said the DKBA was aggressively arresting villagers in its controlled areas and forcing them to serve as porters during the fighting.

The most recent attacks were being launched by Burmese battalions under Light Infantry Division 22 and DKBA battalions 999, 555 and 333, said the Karen sources.

Hla Ngwe said that further attacks and further displacement of Karen villagers were expected.

“As of Saturday, over 3,000 villagers have fled the area of Ler Per Her internally displaced persons’ camp in Dta Greh township, Pa’an district to seek refuge in neighbouring Thailand,” the Karen Human Rights Group (KHRG) said.

The KHRG, set up in 1992 to monitor the six-decade Burma-Karen conflict, claimed it was the biggest exodus since 1997, when the Burmese army launched a massive offensive in the Karen State and  forced tens of thousands of the ethnic minority group into Thailand.

This month’s influx of refugees was sparked by attacks on Karen villages by the Burmese military and their allied forces of the Democratic Karen Buddhist Army (DKBA), the KHRA said.

The Burmese army has been trying to defeat the Karen National Liberation Army (KNLA) since 1949, making it one of the world’s longest lasting insurgencies. The Karen National Union (KNU), the political wing of the insurgency, seeks autonomy for the Karen state in eastern Burma.

The constant fighting, which has intensified over the past decade, has forced more than 100,000 Karen in to Thailand to seek refuge.

Fighting in the Per Her area started on June 2 and intensified Friday when some 900 Burmese and DKBA troops launched multiple 81- millimetre mortars on the camp near the Thai-Burmese border, Karen sources said.

The fighting forced the Per Her population and surrounding villages of more than 3,000 people to flee, joining another 700 who had fled the fighting on June 4.

On Sunday morning fighting had resumed in the Ler Per Her area, KHRG field reports said.

The Karen Human Rights Group is an independent agency set up to document the Karen conflict through direct testimonies, supported by photographic and other evidence.

Thousands flee latest military offensive in Karen State

Chiang Mai (Mizzima) – A Karen rights group said today over 3,000 ethnic Karen refugees fleeing Burmese military operations are facing difficulty finding adequate food, shelter and healthcare along the Thai-Burma border.

A joint force from the Burmese Army and Democratic Karen Buddhist Army (DKBA) is currently launching military operations in a region of Pa-an District under the control of the Karen National Liberation Army’s (KNLA) 7th Brigade. Karen civilians are fleeing the approaching hostile forces to avoid the possibility of serving as forced porters or being used as human mine sweepers.

However, having fled to Thailand’s Tak Province refugees are now confronted with a whole new set of hardships.

“Some have to hide in the forest without shelter. Some use a piece of plastic sheet for the entire family as a makeshift shelter. The Thailand Burma Border Consortium (TBBC) has provided food for these people but it is not enough for them,” Albert, from the Thai-Burma border-based Karen Human Rights Group (KHRG), told Mizzima.

Among the displaced people and refugees are children and the elderly. Though KHRG has reported the number of refugees as over 3,000, in a report yesterday the group cautioned there may be many more refugees thus far out of the reach of vital assistance and therefore remaining unaccounted.

Lieutenant General Tanongsak Apirakyothin of the Thai 3rd Army, which is responsible for the security of Thailand’s West and Northwest regions, confirmed to reporters the figure of about 3,000 Karen refugees reaching Thailand and stressed Thailand is doing what it can to assist the refugees.

While KHRG said they have yet to receive any detailed information on the healthcare services being provided to the refugees, most are said to be suffering from fever, the common cold and headaches, as they had to constantly run in the rain. Some are suffering from malaria too, Albert added.

The joint operation in Karen State is said to include Burmese Light Infantry Brigades 338, 339, 201, 202, 203 and 205 under the command of Light Infantry Division 22 and bolstered by DKBA Brigades 999, 333 and 555, according to the KNU. Though information of today’s military maneuverings cannot yet be confirmed, heavy weapons fire was heard yesterday.

The KNU further emphasized that refugees from the conflict remain in dire need of assistance.

“In some places Thai medical units came and provided medical care. But they cannot provide proper medical care to these people as the diseases found in these places are uncommon to Thai medical personnel. Moreover, there is no proper means of resettlement for them in these places. They should give proper shelter to these people instead of leaving them in open areas exposed to the rain”, Major Saw Hla Ngwe, Secretary (1) of the KNU, explained to Mizzima.

In the opinion of Major Saw Hla Ngwe, the DKBA launched this military operation with the intention of expanding the area under their control and increasing their armed strength in a run-up to transforming their force into a ‘Border Patrol’ unit as per the designs of the junta. At the same time, the Burmese Army is encouraging the operation with the intention of sowing further dissension among the Karen people, speculated the Major.

The Karen have been waging war against successive Burmese governments for nearly half a century with the aim of achieving a right to self-determination. The conflict has resulted in more than 100,000 – predominantly Karen – refugees seeking shelter in nine camps along the Thai-Burma border.

Thailand Re-opens Migrant Worker Registration Program

The Thai government has agreed to offer a new round of registration for work permits for non-citizens illegally working in Thailand, according to Thai non-government organizations.

Jackie Pollock, a founding member of the Thailand-based Migrant Assistance Programme (MAP), said the new registration process requires a recommendation from an employer. The registration process started on Monday.

Myo Thaw, a member of the Labor Rights Promotion Network (LPN), which is based in Mahachai in Samut Sakhon Province said that the new migrant work permits will have different colors to show the category of work.

A worker will have the right to change jobs, but it must be in the same field of work.

According to the LPN, there are 76,000 Burmese workers who have legal work permits and more than 224,000 workers awaiting a new registration cycle in Mahachai.
Meanwhile, the Thai government also has agreed to allow Burmese workers who now hold work permits to apply for work passports from Burma. About 500,000 people are legally registered to work with the Thai ministry of labor.

However, observers said many Burmese are hesitant to apply to the Burmese government for fear of being sent back to Burma.

MAP estimates that there are currently up to five million Burmese migrants living and working in Thailand.

Two Thai policemen raided the Burmese migrant workers’ residences around 9 am yesterday (June 3rd 2009). The police arrested two mothers together with their babies and the mothers were handcuffed. The incident happened in the Wathom area of Mahachai township near Bangkok.

“It was about 9 am when the two policemen came to this area by motorbikes to arrest the workers,” said Ko Win Zaw, a volunteer who is helping Burmese migrant workers in the Bangkok area.

“They arrested two mothers and their babies,” he continued, “the mothers were only 28 and 29 years old and their babies are about only three months old. Two other girls, a five year old and a seven year old who are believed to be the daughters of the detained were also arrested and the police brought both of them together with their mothers and the two babies. The mothers were handcuffed together, clasping their babies with the other hand over their breast. The two girls went along with their mothers, crying along the way.”

Most of the Burmese migrant workers in the Mahachai area are working in fisheries. According to Ko Win Zaw, the husbands of the female detainees are thought to have been fishing in the sea when the incident occured. The mothers together with their three month old babies and two daughters were still detained in a police cells in the Wathon area until yesterday afternoon when the news was reported. A witness said that nobody had come to meet the mothers and their children in the cell yet.

According to data from the Ministry of Labour in Thailand, over one million migrant workers from Burma are now working in Thailand, (according to the UN the number is over 2 million). Among them, over ninety thousands have been registered at labour offices to work legally in various sectors in Thailand. Forty percent of them are working in fisheries and trading, thirty percent are in agriculture and livestock and another thirty percent are working in various industries such as construction, rubber plantation, industries, domestic and others.

Four hundred migrant workers arrested

Four hundred migrant workers and their children were arrested by Thai border guards at around 3 am, yesterday morning. The Thai border guard soldiers raided the “44 Kilo Village” in Phuphaya townsip, south of Mae Sot on the Thai-Burma border. After they arrested four hundreds migrants, including children who are studying in school, the soldiers also burnt the houses, clothes and kitchen wares of migrants in the village who had managed to escaped arrest.

“They ran. The soldiers burnt about three or four houses and about thirty houses in the village were destroyed. They took all the chickens of the villagers,” said Ma Yin Win, a witness who escaped arrest.  ”The three 70-year old people,” she added, “including pregnant women with babies were also arrested. We’re anxious about so many difficulties. We moved to Thailand as it was too difficult for us even to survive in Burma. Thailand’s also not safe for us. We now have so many difficult situations.”

Htike Thu Aung, who is a teacher of migrant children in 44 kilo village, said, “All 120 children from kindergarten to grade five, studying in our school were arrested. They also arrested the people nearby my place. If they want to arrest the workers without work permit cards, ok, they can. Now, why did they even burn the houses of the villagers? The parents of a child from Kindergarten have work permit cards. The child was staying with his grandparents. The soldiers arrested the grandparents together with the child. The child’s parents begged them not to arrest their child but the soldiers did anyway. They even burnt the houses. They’re so cruel!”

The soldiers continuously carried all the arrested migrant villagers by truck from 3 am, early in the morning to 8 am. Last month, the same had happened in that village (44 kilo). The soldiers raided the village and expelled the villagers from the village. Since then the villagers had been hiding in the nearby forest for a month. Now, the soldiers have arrested them and burnt their houses down not long after they returned home from the forest due to it being rainy season.

“The reason for the arrests was not having work permit cards. We don’t understand Abhisit who said that Thailand fully respects human rights. All the workers, working in this area, are from Burma. They don’t get paid full wages. They get the wages from 60 Baht to 100 Baht (US$1.7 to US$ 2.8) per day. All the profits from the workers’ effort are just for Thailand. The Thai authorities should be sympathetic the workers whom they get the profits from,” said Ko Nyo Maung, a teacher in “44 Kilo Village.”

Ko Moe Gyo, the Chairman of Joint Action Committee for Burmese Affair (JACBA), said, “On the 28th of March 2009 the Thai soldiers raided “War Taw Village” which lies about 48 Kilometers from Phuphaya township. They burnt 80 houses and all the houses were destroyed. The villagers fled to the forest. We gave food and other necessary things to two hundred workers who had fled into the forest. The Thai government need to respect human rights as Thailand is a democratic country. It has said that over two million foreign migrant workers will be registered. They should wait until the registration period has finished before they arrest illegal migrant workers. If the workers have work permit cards, it will be good for their health and safety. They will be able to go out safely. However, the firm owners don’t want to help those workers who are working for them. Aside from the police and immigration officers, a Thai volunteer force also harasses the Burmese workers. We don’t like such an unfair behavior.”

According to migrant teachers and volunteers who are working in the “44 Kilo Village” area, the Thai soldiers raided the villages of Burmese workers and burnt their houses twice in 2008 and another twice in 2009, including this time.

Color-coded employment cards for migrant workers issued

Thai labor ministry has recently prescribed color-coded employment cards under the forthcoming registration for workers from Burma, Laos and Cambodia to differentiate the sort of their works, according to the daily Thai newspaper Khomchadleuk reported last week.

Colors described were:

  • Blue card will stand for fisheries
  • Green card – agriculture
  • Yellow card- construction
  • Orange card- seafood factories
  • Gray card- domestic work
  • Pink card – general

Workers holding pink cards are available to get access to 19 types of work, the report said.Even though migrant workers holding new registration cards will be allowed to work legally, they will be only appointed after Thai citizens fail to apply. But they will have the right to get access to the basic rights as Thai citizens.

On 2 June, Alien Employment Administration meeting (Kaw Raw Phaw) made up a new policy that job owners must give priority to Thai citizens allowing them 7 days to apply if there is a job vacancy.

The meeting also reached a decision to offer a new round of labor registration to new migrant workers and existing workers who previously lacked legal status.

“People who entered the country after the decision was made will not be allowed to apply for the registration. They will also be arrested and sent back,” labor minister Paitoon Kaewthong was quoted in the report.

During the registration period, border checkpoints would be strongly tightened to stop outsiders from coming to “seize the opportunity.”

He also said all work permit cards will be expired on 28 February 2010. After that employers must ask their workers to apply for passport document.

In Chiangmai province, the registration for the new workers will start from 1 July, a member of a right group said.

Bosses who are willing to appoint new workers can ask for quota at the Employment Department office, she said.

Now, workers holding current permits have been called upon to apply for another year of extension since early June. They were also required to apply for the nationality verification process at same time, according to a worker who was also required to submit the form.

People who pass the process of the nationality verification by their country will be allowed to work for another 2 years.

According to the report, about 500,000 migrant workers have registered with the labor ministry up to now. There are at least 2 million legal and illegal migrant workers in Thailand.

Mae Sot Workers Hungry for Suu Kyi News

MAE SOT – Factory workers along the Thai-Burma border are simmering with anger over the ongoing trial of Burma’s democracy leader Aung San Suu Kyi.

News of the trial has quickly spread through the factories and ignited quiet outrage amongst the workers. For many of the migrant workers, the Burmese government is to blame for the financial misery which has led them here to the factory floor. Their only hope for being able to return home is the release of Suu Kyi who could now face a further five years imprisonment.

like slaves in another country,” said a knitter in his early 20s in a textile factory. “If she is released, then she will be able to sort out all our country’s problems, and I can go home to my family.”

The workers are shocked by the news coming out of Burma but hardly surprised.

“I knew she was due for release soon so I expected the SPDC would do something,” said another worker from Pegu. “I am angry but because I am a migrant worker I feel so helpless.”

With so many counting on her, the present trial is a great concern for all the migrant workers who anticipate the day they can live and work in Burma.

Relieved from their eleven-hour shifts twice a day, most of the workers catch up on the news during their breaks.

In one knitting factory, workers watch the Democratic Voice of Burma TV in the canteen during lunch. Many of the factories have TVs, but they are often muted or playing Burma’s state channel-MRTV.

In the factories that don’t have TVs, the workers go to the tea shops in the factory compounds and get updates from the radio.

Most workers don’t listen to exiled media radio stations such as the BBC or RFA. Workers are attracted to the “good pop music” on Padauk Myay, a government-owned radio station in Rangoon. Airing at 5:30 am till 8 am, it is convenient for workers to listen to as they prepare for work.

Mae Sot-based organizations suspect it was designed to interfere with exiled media agencies’ programs. Radio listeners in Rangoon have reported Padauk Mayay radio interrupting BBC news programs and temporarily taking over the frequency.

Like all media in Burma the radio stations adhere to the junta’s policy. Although it has reported the Suu Kyi trial, a lot of the details are left out so workers must rely on colleagues who listen to international news for the whole story.

“Not every worker has access to international news,” said one worker. “Some of the workers who know the whole picture have been informing their colleagues who listen to the government radio stations.”

For the latest information many of the workers rely on the handful of organizations that were set up to improve the working and living conditions for migrant workers.

The Yaung Chi Oo Workers Association publishes a monthly magazine that is popular amongst the migrant community, and it has become a source that informs the workers about issues relating to Burma.

Similarly, the Overseas Irrawaddy Association looks after all migrant workers who come from the Irrawaddy delta region. Many of the factory workers frequent the office to get regular updates about the trial. The chairman, Saya Pu, once a student activist, also worked in factories before setting up the organization.

“I set up the organization not for my living but to tell the workers about human rights and democracy,” said Saya Pu. “I push them all to read the news as much as they can.”

Malaysia Secures Coast to Stop Human Smuggling

PUTRAJAYA, Malaysia – Malaysia is deploying helicopters, boats and an aircraft along its coast to catch a rising number of suspected illegal immigrants from Afghanistan and Pakistan, some of whom may have drowned during their perilous boat journeys.

But the saga of the South Asian migrants comes with a twist – they are not trying to enter Malaysia illegally. Instead they are leaving Malaysia illegally on small overcrowded boats to sneak into Indonesia, most likely en route to Australia where they hope to eventually get asylum, officials said in interviews this week.

Many Indonesians, who work here without permits or overstay their visas, also use the boats to exit illegally.

Since March, four boats with 114 Indonesians, 58 Afghans, 37 Pakistanis and three Iraqis have been caught trying to cross from Malaysia toward Indonesia, according to statistics from the marine police and the Malaysian Maritime Enforcement Agency. A request by The Associated Press for interviews with the detainees is being processed.

Maritime officials say it is hard to estimate how many have successfully completed the dangerous passage.

“This is a new trend to us in Malaysia,” Home Ministry Secretary-General Mahmood Adam told AP.

The prospective migrants are believed to pay human traffickers in their home countries, who arrange for them to come to Malaysia on valid tourist visas. Once here, they see the sights in Kuala Lumpur and surrounding areas before setting sail on an uncertain journey.

Mahmood said most of these people are middle-class with means to fund their journey. Many want to escape the war in Afghanistan and in Pakistan’s border region, and all are looking for a better life.

“They have money. They travel all over the world. So how to refuse their visa application? It’s very difficult,” Mahmood said.

In late April, a boat carrying a Pakistani family overturned, and only a 14-year-old boy survived. All six family members including his mother, siblings and uncles drowned.

The Pakistani Embassy said the family – in Malaysia on tourist visas – was on a legitimate pleasure boat trip but police are investigating whether they paid smugglers to take them to Indonesia.

Early Thursday, two boats with 32 illegal Indonesian immigrants capsized in choppy waters off southern Johor state, leaving one woman dead and nine missing, Johor marine police chief Mohamad Khamsani Abdul Rahman said. The 22 others, including a suspected boatman, were rescued.

A third boat sank last month, killing eight Indonesians.

First Adm. Ahmad Puzi Abdul Kahar of the Malaysian Maritime Enforcement Agency said coastline surveillance was stepped up after the first tragedy in March.

He said an aircraft, helicopters and boats patrol the coast, and officers from all agencies are gathering information from fishermen and other locals about illegal vessels.

For now the human trafficking syndicates seem to have been intimidated and their activities have decreased, but policing peninsular Malaysia’s 1,073-mile (1,727-kilometer) long coastline remains difficult.

“The issue is like a balloon. When you tighten here, they will go to the other side … Of course we have to tighten (security) everywhere,” Ahmad Puzi said.

On May 28, a wooden boat packed with Afghan migrants sank off western Indonesia, killing at least nine people and leaving 11 others missing. The Afghans, who were rescued, told Indonesian authorities they flew from Afghanistan to Malaysia, where human traffickers offered to help them get by boat to Australia.

Capt M. Karunanithi, a senior official with the Malaysian maritime agency’s crime investigation department, said the migrant flow increased when Australia eased immigration restrictions last year.

He said among the Pakistanis and Afghanis arrested in Malaysia were two doctors and an information technology specialist, and many carried between $3,500 and $4,000 cash on them. Some told their interrogators they had relatives in Australia, Karunanithi said.

Those arrested have been jailed up to six months for exiting Malaysia illegally before being deported, he said.

Six people killed and others injured in truck accident

A truck loaded with twelve Burmese migrant workers, had an accident at 4 am on the 2nd of June, 2009. The truck crashed into a six-wheeled truck and overturned near mile post number 15 near the Chainat area, Tumbon Prasriracha township of Kanchanaburi Province, Thailand.

The accident killed five workers on the spot and another injured one died as soon as he arrived at the hospital. Some other injured workers in the accident are under the treatment of the intensive care unit at Sanglauri Hospital. Other workers who had minor injuries are being taken to the police station of Sanglaburi township, Kachanaburi Province as soon as they are discharged from the hospital.

The police officer from the criminal department of Sanglaburi police station said, “The truck crashed into a six-wheeled truck. We don’t know who the driver was. He escaped. We’ll deport all the injured workers to the border when they completely recover. We don’t have the right to arrest the foreign migrant workers who don’t have a stable job. The Thai government has recently coded a regulation to deport them all to the border.”

A nurse, who was on duty at the hospital, said, “The five dead bodies of female Burmese workers were brought to the hospital. The two male workers were seriously injured and one died in the intensive care unit while receiving special treatment. The last one, who’s still alive, is also in serious situation. He’s still in a coma. In total, five women and one man have died.”

“I don’t know where the other victims are from,” said the neighbour of the three victims, “but one of them stayed near me. One lived in Kawtalay village, Kawgraid township and she was 22. Another two were aged 23 and 29. They smuggled into Thailand through brokers. The driver who brought the dead bodies to the hospital told me to come and collect the dead bodies. How can we afford to pay for the funeral of the victims?”

The number of Burmese migrant workers smuggling into Thailand through Thai-Burma border, are increasing because of their country’s downturned economic situation under the military regime’s domination of the country. The severity of the smuggling racket made international headlines in April last year when 54 Burmese suffocated to death in the back of a truck while on their way to Phuket. Some workers died on the trucks in check points when the police poked sharp iron rods into the surface of vegetables under which the smuggled workers were hiding. Some migrant workers were killed by the Thai gang stars, Thai police and village authorities.

Thailand: Discrimination Against Burmese Migrants

Thailand: Submission Of ILO Complaint Regarding Systematic Discrimination Against Burmese Migrants In Thailand

Mr. Sawit Keawan, General Secretary of Thailand’s State Enterprise Workers Relations Confederation (SERC*), today, file a complaint with the International Labour Organisation (ILO) during the 98th International Labour Conference in Switzerland. This complaint alleges that the Royal Thai Government (RTG) is breaching the ILO’s Equality of Treatment (Accident Compensation) Convention (C-19) by denying Burmese migrant worker access to the Social Security Office’s (SSO) Workmen’s Compensation Fund (WCF) following accidents at work.

On 4th December 2006, Nang Noom Mae Seng, a 37-year old Shan migrant worker from Burma, was left paralysed after being struck by a 300 kilogram mould at her worksite. Her official compensation claim was rejected by Thailand’s SSO. This was because she could not satisfy conditions for access to the WCF laid down in a 2001 SSO circular, requiring that: (1) Workers must possess a passport or alien registration documents; and (2) Their employers must have paid a dividend into the WCF. These conditions make it generally impossible for Burmese migrants to access the WCF.

The system for importing workers from Burma into Thailand continues to be a failure because of disagreements between the two Governments on verifying nationality of Burmese migrants already in Thailand. So Nang Noom and most of the other two million Burmese migrants in Thailand originally entered without documents. But over 500,000 of these workers have obtained a residence certificate and work permit allowing them to work ‘legally’ in Thailand. The problem is that the SSO refuses to accept these documents to meet requirements to gain access to the WCF.

There appears to be another double standard between Thai and migrant workers. The SSO prohibits employers of migrant workers from paying dividends into the WCF. Yet at the same time, regulations say that it is the responsibility of all employers who have one or more ‘workers’ to pay these dividends, and that it is the duty of the SSO to enforce this regulation. So when the employer of Thai workers fails to pay such dividends into the Fund and then one of their Thai workers has an accident, the SSO makes that employer pay retroactively into the Fund, and then Fund can then pay compensation to the victim directly. But for the injured migrant worker, this is not allowed.

As almost all migrant work accident victims in Thailand cannot satisfy conditions to access the WCF, their employers must pay them compensation directly. The problem is this creates the opportunity for employers to evade taking responsibility. As a result, many employers do whatever they can to avoid compensating their injured migrant worker. Thailand has thus created an informal system for compensating migrant work accident victims that results in the effective denial of access to compensation. Only in the most rare cases, where the injured migrant worker receives extensive legal and other assistance from a labour union, NGO or other group, does the migrant worker have a possibility of getting compensation. So there is a difference in treatment between ‘workers’ on the basis of nationality, and this is clearly discriminatory.

As a result of this systematic discrimination against Burmese migrant workers, the RTG is failing to adhere to ILO Convention 19 which requires equal treatment regarding work accident compensation between nationals and non-nationals. SERC is therefore beginning to utilize the ILO’s supervisory mechanisms as part of continued attempts to convince the Ministry of Labour (MoL) to cease denying these fundamental rights to vulnerable migrant workers.

SERC has pressed senior MoL officials to address the fact that Burmese work accident victims rarely receive adequate compensation, but the MoL has ignored our requests. Three court cases have been filed against the SSO, but Thailand’s courts have been unable to deal with them. The National Human Rights Commission of Thailand has issued recommendations, which were ignored by the MoL. Finally, in March 2009, international complaints were submitted alleging violations of the UN Convention on Elimination of Racial Discrimination.

Despite all these efforts by SERC and our networks in Thailand, millions of Burmese migrant workers continue to be denied official work accident compensation.

This example of discrimination that SERC highlights today is just one of many experienced by migrant workers in Thailand, who work hand in hand with Thai workers to develop the Thai economy. Instead of integrating foreign workers into our society, the RTG continues to deny them fundamental rights in many parts of their lives.

The predatory policies of the Burmese military have already created an environment of repression and economic deterioration that force millions of Burmese to seek refuge and a better life in our country. These workers have faced abuses enough already and must not also be denied rights under ILO Convention 19, which has been ratified by Thailand.

In an era of global migration, international labour standards must be enforced in migrant receiving countries to ensure migrants work in acceptable conditions. The ILO Declaration on Fundamental Principlesand Rights at Work proclaims ‘the ILO should give special attention to the problems of migrant workers.’ The ILO Constitution also provides that if any of the ILO’s member states fail to secure effective observance of a Convention to which they are party, worker organisations can take this non-compliance to the ILO’s Governing Body.

Thailand’s refusal to respect ILO Convention 19 should now be brought before the ILO’s Governing Body. This should provide additional pressure on the RTG to remove obstacles unfairly faced by Burmese migrants seeking access to work accident compensation. The ILO must also keep continued failings by the Burmese junta at the top of its agenda, as this is the root cause of an increasingly irregular migration flow from Burma into Thailand.

Karen villagers flee to escape battlefront

Chiang Mai (Mizzima) – Several hundred ethnic Karen have crossed into Thailand as fears of fresh fighting between the Burmese Army and the Karen National Liberation Army (KNLA) echo along the border.

Colonel Phadung Yingpaiboonsuk, Commander of the 4th Infantry Division of the Thai Army, has ordered military and administrative officials in Tak Province on the border of Karen State to look after 16 families, a total of 85 people, newly arrived in the Kingdom as asylum seekers. They are currently staying at Thammajarik Monastery and being provided with food and medical care in addition to 24-hour security.

The Thai Army is also preparing an emergency plan for local Thai villagers in case the fighting spills over the border.

Other groups of Karen are reportedly sheltering in the villages of Tungtham, Nong Bua, Mae Salid and Mae Usu after hearing that Burmese Army and Democratic Karen Buddhist Army (DKBA) forces are preparing to attack the KNLA’s 7th Brigade near Thasongyang District, west of Thailand. The battleground is a mere three to four kilometers from Thai territory.

An official in Tak Province revealed that the Thai military has reinforced its troops along the border with Karen State after fighting between the KNLA and Burmese Army affected local villagers in the area.

“The villagers have crossed the Moei River by long-tail boat at several points in Tak Province’s Thasongyang District. Thai authorities will take care of them and provide humanitarian aid. However, it is possible that the fighting will become more serious,” according to a report in the Thai newspaper Matichon on Friday.

The current military campaign kicked off in April of this year, pitting the Burmese Army and its ally the DKBA against the KNLA, the armed wing of the Karen National Union. The Burmese Army previously burnt down several buildings in Wah Lay Kee Refugee Camp after overrunning the base.

In April, the Thai Army twice submitted a Memorandum of Understanding in protest against the Burmese Army for discharging mortar fire that landed in Tak Province, injuring two Thai soldiers.

Additionally, about 200 Thai villagers from Phadee were temporality relocated for several days deeper inside Thai territory out of concern for their safety. Local authorities have since found a number of unexploded ordinances, including landmines, left in the village as a result of the fighting.

Over 700 villagers flee to Thailand amidst fears of SPDC/DKBA attacks on a KNLA camp and an IDP camp in Pa’an District

 

Villagers in Pa’an District, Karen State, have begun fleeing to Thailand to avoid violence and forced recruitment as porters in possible a joint SPDC/DKBA attack on a KNLA camp in Dta Greh Township, located next to a now populous IDP camp along the Moei River, bordering Thailand. This news bulletin describes the events of the past four days in which SPDC and DKBA forces have advanced towards the KNLA camp and begun what appears to be preparation for an attack. SPDC soldiers have begun patrolling and have set up an 81 mm mortar not far from the site and displaced villagers living in the area have become increasingly concerned about their safety.

As of Friday, June 5th 2009, over 700 villagers from Dta Greh Township of Pa’an District, Karen State, have fled to Thailand in order to avoid fighting between joint State Peace and Development Council (SPDC) / Democratic Karen Buddhist Army (DKBA) forces and Karen National Liberation Army (KNLA) soldiers. In total around 250 soldiers from SPDC Light Infantry Battalions #202 and 205 and Infantry Battalion (IB) #81 and DKBA Brigade #999 have advanced in what appears to be preparation for an attack on KNLA Battalions #101, 21 and 22. Such an attack would fit the wider pattern of SPDC/DKBA operations against KNLA positions throughout Pa’an and Dooplaya districts in the lead-up to the 2010 elections in Burma.

On June 1st 2009, DKBA soldiers from Brigade #999 began arresting villagers in T’Nay Hsah Township to serve as porters carrying supplies in upcoming military operations. KHRG field researchers have reported that 50 villagers from the area fled to Thailand on June 1st in order to avoid this forced labour as military porters.

Later the same day, SPDC LIBs #202 and 205 and IB #81 along with soldiers from DKBA Brigade #999, led by battalion commander San Bpyot, advanced to an area in Dta Greh Township located about a one to two hour walk away from a KNLA camp. Previously, the SPDC had a single battalion stationed at this site which remained in the camp without patrolling. DKBA #999 earlier had about 10 soldiers stationed in the area. However, with the recent advance, the numbers of both SPDC and DKBA soldiers in the area have increased. The SPDC has also begun patrolling the area and the DKBA has started sending in rations in increased amounts.

The KNLA camp housing Battalions #101, 21 and 22 is located near to Ler Per Her, a large camp for Internally Displaced Persons (IDPs) along the Thailand border. This camp now has a population of over 1,200 people, mostly comprising villagers who previously fled attacks and abuse elsewhere in Pa’an District. The recent advance appears to indicate a possible coming attack by the joint SPDC/DKBA forces on the KNLA camp. Upon arrival, around 200 soldiers from four columns of SPDC LIBs #202 and 205 began patrolling around Gklay Moh Kee, Gklay Poh Kee, Mae Lah Ah, Mae Lah Ah Kee, See Poh Kee, Htee Gkaw Haw and Wah Mee Gklah villages, all of which lie in Wah Mee Gklaw village tract, Dta Greh Township. Subsequently, on June 2nd 2009, residents from at least some of these villages began fleeing to Thailand (located about a one hour walk away) as they feared that if the attack occurred soon, they would be used by the SPDC and DKBA soldiers as porters or minesweepers.

On June 2nd and 3rd, KNLA soldiers launched two guerrilla-style attacks on the SPDC troops and planted landmines near to the area where the SPDC soldiers were patrolling. According to reports, eight SPDC soldiers were injured and five SPDC soldiers killed in the KNLA attacks. Then on June 4th, KNLA soldiers again attacked the SPDC troops.

As of Friday, June 5th 2009, KHRG field researchers reported that over 700 villagers had fled the area. This includes 132 people from 21 households in See Poh Kee village; 277 people from 46 households in Mae Lah Ah Kee village; and 312 people from 44 households in Mae Lah Ah village; all of whom have arrived at Oo— village in Ta Song Yang District of Tak Provice, Thailand. Villagers who have fled from the other four villages located near to the SPDC patrols include residents of Wah Mee Gklah who have taken refuge at T— village, also located in Ta Song Yang District.

On June 3rd, a DKBA officer from Brigade #999, who was operating with the SPDC soldiers, telephoned one of the village secretaries who was amongst those who had fled and urged him and fellow villagers to return to their homes in Dta Greh Township. The officer said that the DKBA would protect the villagers from abuse by the SPDC. However, KHRG field researchers report that the villagers remain wary of returning because they have had experience with abuse by DKBA soldiers in the past. Local KNLA soldiers reportedly told the displaced villagers they did not know whether or not the DKBA would honour its promise to prevent SPDC abuse or instead arrest those who returned and make them serve as porters. KNLA soldiers further warned that if the villagers were arrested and used as porters in an attack on the KNLA camps in Dta Greh Township, they would risk injury or death from the landmines which the KNLA had earlier deployed.

On June 4th, KHRG field researchers reported that the SPDC soldiers had set up an 81 mm mortar at the top of Bpoo Loo Dtoo hill, which is located above the KNLA camp and about five kilometres (about 3 miles) from Ler Per Her IDP camp in Dta Greh Township. Five kilometres is just within range of an 81 mm mortar. Villagers living in Ler Per Her IDP camp are thus increasingly concerned about their security and some have begun heading to Thailand for safety in case there is an attack on the site.

Attacks on KNLA Continue

The Burmese army and the ceasefire Democratic Karen Buddhist Army (DKBA) are shelling the main base of Brigade 7 of the Karen National Liberation Army (KNLA) with long-distance mortars, according to Karen sources.

Karen relief and human rights organizations said that the Burmese army and DKBA troops have started advancing on the Brigade 7 base following a long-distance attack on KNLA Battalion 21 that began at 1 am local time today.

A new offensive by pro-junta forces that began on June 1 with an attack on KNLA Brigade 6 has displaced more than 2,000 people, forcing many to flee to Thailand, according to Karen aid groups.

David Takapaw, the vice-chairman of the KNLA’s political wing, the Karen National Union (KNU), said that the DKBA was recruiting about 20,000 troops to launch more attacks.

He added that the current offensive appeared to be aimed at eliminating KNLA bases along the Thai-Burmese border ahead of a push by the Burmese junta to establish a new border security force consisting of DKBA troops under the command of the Burmese army.

The recent attacks were being launched by Burmese battalions under Light Infantry Division 22 and DKBA Battalion 999, according to the KNU.

Karen refugees are now staying in Ta Song Yang District in Thailand’s Tak Province, according to the Karen Human Rights Group (KHRG).

Poe Shen, a field director for the KHRG, said the fleeing villagers include residents of the villages of See Poh Kee, Mae Lah Ah Kee and Mae Lah Ah in Pa-an District.

Poe Shen said it was risky for Karen refugees to stay in a camp for internally displaced persons in Ler Per Her, on the Thai border, because the camp is located near KNLA Battalions 101, 21 and 22. The camp houses more than 1,200 people from Pa-an District.

In response to the offensive, KNLA soldiers launched two guerrilla-style attacks on Burmese troops on June 2-3 and planted landmines. Five Burmese soldiers were reported killed and eight injured in the attacks, according to a KHRG report.

FBR REPORT: Thousands of Refugees Flee Ler Per Her Camp as Burma Army Attack Begins

Some 3,295 people have fled Ler Per Her camp as Burma Army and Democratic Karen Buddhist Army soldiers started the bombardment of the camp at 11.30am on June 6.

Hundreds of soldiers surround the camp which is on the Thai/Burma border north of Mae Sot and refugees are crossing the border into Tha Song Yang district in Tak province, Thailand, to escape the attack. Those in the camp had already fled attacks from the Burma Army in eastern Karen State numerous times and had established homes there, which now have to be abandoned.

Since October 2008 over 60 families have arrived in Ler Per Her, 40 of those from within the last week from Htee Per village. They fled because of Burma Army/DKBA activity and because the Burma Army was looking to recruit over 800 soldiers from the area. Soldiers have already arrested and forced villagers from Pa-an District and Myawaddi Township to porter supplies for this campaign. The attack is being led by Light Infantry Battalions 81, 201, 202 and 205, supported by some 300 soldiers from DKBA 999.

Those who have fled across the border are in Mae U Su, Noh Bo and Mae Salik and are in urgent need of shelter, medical assistance, food and clothing. An FBR team in association with Partners Relief and Development are bringing desperately needed supplies. So far PRAD has delivered 30 pots, 25 large tarps, mosquito repellant, food, rolls of plastic sheeting, two trucks of clothing and medicines for 200 cases of each of the following illnesses: malaria, diarrheal diseases, respiratory illnesses, wound care and painkillers. The leader of the camp confirmed that women and children had left the camp by June 5 leaving the older people and men. He asked for prayer for his people.

178 Burmese Muslim Pushed Back to Burma in 4 Days

By Tun Kyaw, Coxs bazar: Within four days 178 Rohingya Muslims from Burma who entered Bangladesh illegally were arrested and pushed back across the border to Burma by Bangladesh authorities, a source reports.

The individuals were arrested by Bangladesh Rifles Battalion No. 17 in the area of Bangladesh’s Ukia Sub-division under Cox’s Bazar District on the border of Maungdaw Township in Arakan State as they attempted to enter Bangladesh illegally to seek refuge.

Many Rohingyas were arrested on a bus in an area of Phalaung Khali while another 25 were arrested on a bus in the area of Balukhali in Ukia Sub-division, on the Teknaf – Cox’s Bazar highway last Wednesday when authorities set up checkpoints for buses traveling that route.

Rohingyas from Burma have been illegally entered Bangladesh in groups one after another over the last month. “The flow of Burmese Muslims into Bangladesh has been unabated,” said a border security officer on the condition of anonymity.

Local newspapers claim that Burmese entering Bangladesh are mixing into populations in the Chittagong Hill Tracts and causing crime and social unrest.

Due to the increasing numbers of Rohingyas fleeing Burma and entering Bangladesh, a committee comprised of 17 government departments was formed to prevent an influx of Rohingyas from Burma, said an official report.

Over 3,000 villagers flee to Thailand amidst ongoing SPDC/DKBA attacks

As of Saturday June 6th, over 3,000 villagers have fled the area of Ler Per Her IDP camp in Dta Greh Township, Pa’an District to seek refuge in neighbouring Thailand. This includes villagers fleeing joint SPDC/DKBA attacks against the KNLA as well as those fleeing forced recruitment as porters to carry supplies for SPDC and DKBA troops engaged in the fighting. This is the largest refugee exodus from Karen State on a single occasion since 1997. Also, more refugees are expected as joint SPDC/DKBA forces have advanced towards the camp of KNLA Battalion #202, about 30 kilometres north of Ler Per Her.

On June 5th 2009, KHRG reported that over 700 villagers had fled to Thailand between June 2nd and 5th in order to avoid forced labour carrying military supplies for joint State Peace and Development Council (SPDC) / Democratic Karen Buddhist Army (DKBA) forces in an attack on a Karen National Liberation Army (KNLA) camp.[1] This KNLA camp is located near to Ler Per Her camp for Internally Displaced People (IDPs) in Dta Greh Township, Pa’an District. At the time, displaced villagers residing at Ler Per Her had already begun to leave in expectation of the coming SPDC/DKBA attack. By the end of June 5th, the entire civilian population of Ler Per Her had fled to Thailand.

Subsequently, on Saturday, June 6th, according to KHRG field researchers operating in the area, SPDC soldiers from Light Infantry Battalions #202 and 205 and Infantry Battalion (IB) #81, under Light Infantry Division (LID) #22, along with DKBA soldiers from Brigade #999 began attacks on KNLA Battalions #101, 21 and 22, of Brigade #7, based near to Ler Per Her IDP camp. At approximately 1:00 pm on June 6th, SPDC soldiers located atop Bpoo Loo Htoo hill overlooking both Ler Per Her and the KNLA camp, began shelling the KNLA camp with multiple 81 mm mortars. Then at about 3:40 pm, the SPDC and DKBA soldiers advanced in a ground attack on the KNLA camp. The Dta Greh Township chairperson, himself a local villager, has estimated that over 900 combined SPDC and DKBA soldiers are involved in the current attacks. At around 6:00 pm the same day, the fighting died down somewhat but occasional rifle shots continued. On the morning of Sunday, June 7th 2009, local KHRG field researchers reported that fighting had resumed in the Ler Per Her area.

Including those villagers from the surrounding area, over 3,000 refugees have now fled to avoid the attacks as well as forced labour carrying military supplies for SPDC and DKBA soldiers. This is the largest refugee exodus from Karen State on a single occasion since the SPDC’s massive 1997 offensive in Dooplaya District further south. The villagers from Ler Per Her and the surrounding area are now taking refuge at numerous areas in Tha Song Yang District of Thailand’s Tak Province. As many villagers have fled to different locations, KHRG field researchers operating in the areas do not yet have the exact number of refugees from some of the abandoned villages. Available numbers of the people and households from Ler Per Her and nearby villages who have recently fled to Thailand are indicated in the table below.

Other sources reporting the recent displacement have cited similar figures. According to the Karen-language news agency Kwekalu, more than 3,400 villagers have fled to Thailand from the area and have taken shelter at Htoo Hta, Mae Ploo, Au Thoo Hta and Mae Salik.[2] The Free Burma Rangers have reported that 3,295 villagers have fled to Thailand from the Ler Per Her area and have taken refugee at Mae U Su and Noh Bo as well.

Meanwhile, as attacks and displacement in the Ler Per Her area continue, combined soldiers from DKBA Brigade #555, under the command of Bya Bya, and SPDC LIB #201, also under LID #22, have advanced towards the camp of KNLA Battalion #202, which is located along the Moei River bordering Thailand, about 30 kilometres north of Ler Per Her. Expecting that the joint SPDC/DKBA forces will soon attack this area as well, residents of nearby Kler Khah, Htee Khoh Kee and Meh Gkreh villages began leaving for Thailand on Sunday, June 7th. A KHRG field researcher operating in the area has reported that those who have not yet left these villages are planning to flee shortly.

As it is now rainy season, these refugees, including many women and children, face serious humanitarian concerns and are in urgent need of support including blankets, mosquito nets and plastic tarpaulins. They lack sufficient shelter, food and heath provisions and schools have had to shut down. Local groups have already provided some assistance, but this has been limited. The Karen Refugee Committee (KRC) has provided about a week’s worth of food aid, but as more refugees arrive, this aid will have to be spread between larger numbers of people. The international community must not continue to neglect the ongoing humanitarian and human rights crisis in these areas.[4]

Burma’s Karen flee army offensive

About 3,000 ethnic Karen villagers have reportedly fled from Burma into Thailand in recent days because of a new Burmese military offensive.

Aid groups say the refugees are from Ler Per Her camp in eastern Karen state, near where the Burmese army is reported to be attacking Karen rebels.

It is thought to be one of the largest movements of refugees across the Thai-Burma border in a decade.

Meanwhile Burma still faces pressure to halt Aung San Suu Kyi’s trial.

The pro-democracy leader is charged with breaching the terms of her house arrest, a charge that could leave her in jail for up to five years.

Former Singapore Prime Minister Goh Chok Tong visited Burma on a “goodwill trip” on Monday, as international anger against the regime continued to mount.

‘Largest exodus for a decade’

The Free Burma Rangers aid group said refugees began streaming out of the Ler Per Her camp on Friday and continued to arrive in Thailand throughout the weekend.

The Karen Human Rights Group, a Thai-based humanitarian group, put the number of refugees at about 3,000 – and so too did a Thai army official speaking to local media.

The Burmese government has refused to comment on these reports.

The Karen Human Rights Group said the influx was “the largest exodus from Karen state on a single occasion” since the government launched a major offensive against the Karen rebels in 1997.

The refugees are now taking shelter about 100 km (62 miles) north of Mae Sot, a Thai border town.

The rights group Christian Solidarity Worldwide and other organisations have called on the United Nations to intervene to prevent a humanitarian crisis along the border.

Rebels from the Karen National Union (KNU) have been fighting for greater autonomy from Burma’s central government for more than half a century.

But the KNU is weakening under the impact of continued army offensives, as well as divisions within its ranks and with other Karen groups.

Another group, the Democratic Karen Buddhist Amy (DKBA), made a pact with the Burmese government and is reportedly now involved in the current fighting on the government side.

Clashes Force More Karens to Thailand

Ongoing attacks by a joint force of Burmese army and breakaway Democratic Karen Buddhist Army (DKBA) troops against the rebel Karen National Liberation Army (KNLA) Brigade 7 in southern Karen State have resulted in more than 3,500 Karen villagers from Pa-an District fleeing to Thailand since June 1 without sufficient food, shelter, clothing or medical care.

Emergency assistance for the new wave of Karen refugees is urgently needed, said Karen relief groups.

Several observers have said that the recent wave of attacks against the Karen rebels could be part of a strategy to divert attention from the ongoing trial of pro-democracy leader Aung San Suu Kyi in Rangoon. Others have speculated that the skirmishes are a belligerent response to the Thai government because of its public criticism of Burma’s handling of Suu Kyi’s trial.

Battalions of the DKBA and the Burmese army, also known as the Tatmadaw, have been reinforcing their troop numbers since early June and it is now estimated that about 9,000 armed soldiers-including an unknown number of porters-have amassed in strategic areas of Karen State in preparation for further military operations against KNLA Brigade 7, according to Karen sources.

Kavi Chongkittavorn, a columnist with the Bangkok-based English newspaper The Nation, reported on Monday that the ongoing attacks against the KNLA near the Thai-Burmese border were “timed to create chaos among Thai decision-makers,” perhaps indicating that Thai policy makers would be kept busy with the influx of Karen refugees on Thai soil.

In its current position as chairman of the Association of Southeast Asian Nations, Thailand had rebuked the Burmese junta for its trumped-up charges against Burmese opposition leader Suu Kyi. Burmese state-run newspapers angrily responded by accusing the Thais of interfering in Burma’s internal affairs.

The Nation columnist added that the military onslaughts also seem to have been designed to “drive a wedge in Thai-Chinese cooperation on Burma.”

Food, shelter, clothing and medical treatment are urgently needed as the Karen refugees could carry few belongings and are camped in the rain on the banks of the Moei River, with no proper shelter and little food. Some refugees are now hiding in jungle and will be at higher risk of diseases such as malaria as the rainy season commences.

Joint secretary 1 of the KNLA’s political wing, the Karen National Union (KNU), Maj Hla Ngwe, said that the offensive may be a part of a Burmese regime reaction to annoy Thailand.

He said the offensive is a signal that the Burmese regime does not seriously want to negotiate with the KNU and sign a ceasefire agreement.

David Thakapaw, the joint-secretary of the KNU, said the offensive was a smokescreen to divert world attention from the trial of Suu Kyi.

He concurred that the offensive was an indication that the Burmese regime does not want to talk about a ceasefire with the KNU.

However, Thakapaw said that the KNU was ready to fight against the Burmese army if the regime does not want to talk about a ceasefire agreement with the KNU and establish national reconciliation.

In April, Thai Foreign Minister Kasit Piromya passed on a message to KNU leaders reportedly sent by Burmese Prime Minister Gen Thein Sein that Burmese authorities wanted to negotiate with the KNU.

After meeting with the Thai foreign minister, KNU leaders reported to Kasit that they had agreed to meet with the junta’s representatives.

However, there has been no further contact from the Burmese authorities since then, according to KNU sources.

Htay Aung, a Burmese researcher with the exiled Network for Democracy and Development, said the offensive would appear to be part of the Burmese regime’s military activities to pressure the KNU to disarm.

“The Burmese regime does not want the KNU to be stable, because they think that the KNU is the leading player among the Burmese opposition groups in exile. So, they are always trying to destroy the KNU in any way they can,” he said.

According to Karen human rights and relief groups, clashes between the armed factions occurred throughout the weekend of June 6-7, but started during the first week of May.

Poe Shen, the field director for the Karen Human Rights Group, confirmed that an estimated 3,500 Karen refugees had fled their homes and are now staying in Tha Song Yang district in Thailand’s Tak Province.

Saw Steve, of the Karen relief group Committee for Internally Displaced Karen People, said the DKBA was aggressively arresting villagers in its controlled areas and forcing them to serve as porters during the fighting.

The most recent attacks were being launched by Burmese battalions under Light Infantry Division 22 and DKBA battalions 999, 555 and 333, said the Karen sources.

Hla Ngwe said that further attacks and further displacement of Karen villagers were expected.

More than 3,000 ethnic Karen have fled fighting in Burma for refuge on the Thai border, the largest such exodus since 1997, a human rights group said Sunday.

“As of Saturday, over 3,000 villagers have fled the area of Ler Per Her internally displaced persons’ camp in Dta Greh township, Pa’an district to seek refuge in neighbouring Thailand,” the Karen Human Rights Group (KHRG) said.

The KHRG, set up in 1992 to monitor the six-decade Burma-Karen conflict, claimed it was the biggest exodus since 1997, when the Burmese army launched a massive offensive in the Karen State and  forced tens of thousands of the ethnic minority group into Thailand.

This month’s influx of refugees was sparked by attacks on Karen villages by the Burmese military and their allied forces of the Democratic Karen Buddhist Army (DKBA), the KHRA said.

The Burmese army has been trying to defeat the Karen National Liberation Army (KNLA) since 1949, making it one of the world’s longest lasting insurgencies. The Karen National Union (KNU), the political wing of the insurgency, seeks autonomy for the Karen state in eastern Burma.

The constant fighting, which has intensified over the past decade, has forced more than 100,000 Karen in to Thailand to seek refuge.

Fighting in the Per Her area started on June 2 and intensified Friday when some 900 Burmese and DKBA troops launched multiple 81- millimetre mortars on the camp near the Thai-Burmese border, Karen sources said.

The fighting forced the Per Her population and surrounding villages of more than 3,000 people to flee, joining another 700 who had fled the fighting on June 4.

On Sunday morning fighting had resumed in the Ler Per Her area, KHRG field reports said.

The Karen Human Rights Group is an independent agency set up to document the Karen conflict through direct testimonies, supported by photographic and other evidence.

Thousands flee latest military offensive in Karen State

Chiang Mai (Mizzima) – A Karen rights group said today over 3,000 ethnic Karen refugees fleeing Burmese military operations are facing difficulty finding adequate food, shelter and healthcare along the Thai-Burma border.

A joint force from the Burmese Army and Democratic Karen Buddhist Army (DKBA) is currently launching military operations in a region of Pa-an District under the control of the Karen National Liberation Army’s (KNLA) 7th Brigade. Karen civilians are fleeing the approaching hostile forces to avoid the possibility of serving as forced porters or being used as human mine sweepers.

However, having fled to Thailand’s Tak Province refugees are now confronted with a whole new set of hardships.

“Some have to hide in the forest without shelter. Some use a piece of plastic sheet for the entire family as a makeshift shelter. The Thailand Burma Border Consortium (TBBC) has provided food for these people but it is not enough for them,” Albert, from the Thai-Burma border-based Karen Human Rights Group (KHRG), told Mizzima.

Among the displaced people and refugees are children and the elderly. Though KHRG has reported the number of refugees as over 3,000, in a report yesterday the group cautioned there may be many more refugees thus far out of the reach of vital assistance and therefore remaining unaccounted.

Lieutenant General Tanongsak Apirakyothin of the Thai 3rd Army, which is responsible for the security of Thailand’s West and Northwest regions, confirmed to reporters the figure of about 3,000 Karen refugees reaching Thailand and stressed Thailand is doing what it can to assist the refugees.

While KHRG said they have yet to receive any detailed information on the healthcare services being provided to the refugees, most are said to be suffering from fever, the common cold and headaches, as they had to constantly run in the rain. Some are suffering from malaria too, Albert added.

The joint operation in Karen State is said to include Burmese Light Infantry Brigades 338, 339, 201, 202, 203 and 205 under the command of Light Infantry Division 22 and bolstered by DKBA Brigades 999, 333 and 555, according to the KNU. Though information of today’s military maneuverings cannot yet be confirmed, heavy weapons fire was heard yesterday.

The KNU further emphasized that refugees from the conflict remain in dire need of assistance.

“In some places Thai medical units came and provided medical care. But they cannot provide proper medical care to these people as the diseases found in these places are uncommon to Thai medical personnel. Moreover, there is no proper means of resettlement for them in these places. They should give proper shelter to these people instead of leaving them in open areas exposed to the rain”, Major Saw Hla Ngwe, Secretary (1) of the KNU, explained to Mizzima.

In the opinion of Major Saw Hla Ngwe, the DKBA launched this military operation with the intention of expanding the area under their control and increasing their armed strength in a run-up to transforming their force into a ‘Border Patrol’ unit as per the designs of the junta. At the same time, the Burmese Army is encouraging the operation with the intention of sowing further dissension among the Karen people, speculated the Major.

The Karen have been waging war against successive Burmese governments for nearly half a century with the aim of achieving a right to self-determination. The conflict has resulted in more than 100,000 – predominantly Karen – refugees seeking shelter in nine camps along the Thai-Burma border.
